DATE: 30 March 2010 RECOMMENDATION• It is recommended that the City Council approve Proposed Resolution No. 15821, awarding a bid and authorizing the execution of a One (1) Year Contract for crack sealing of concrete and asphalt pavement to Scodeller Construction of Wixom, Michigan. This contract will be awarded on a UNIT COST BASIS and will be utilized for various Gty and CDBG funded street projects. BACKGROUND• This is the second awarding of an annual contract for crack sealing of concrete and asphalt pavement. Scodeller was the contractor awarded the contract for this service last year, also. This contract is to preserve and protect existing streets by limiting water infiltration to the subgrede. Bids were advertised in the Port Arthur News on 07 February 2010 and 14 February 2010. Five (5) bids were received and opened on 24 February 2010, as shown on the attached bid tab. BUDGETARY/FISCAL EFFECT• the CDBG street project accounts. -arrd-in STAFFING/EMPLOYEE EFFECT• ` Acceptance of this recommendation will have no staffing/employee effect at this time. $UMMARY• It is recommended that the City Council approve .Proposed Resolution No. 15821,. awarding a bid and authorizing the execution of a One (1) Year Contract for crack sealing of concrete and asphalt pavement to Scodeller Construction of Wixom, Michigan. A RESOLUTION AWARDING A BID AND AUTHORIZING THE EXECUTION OF A ONE (1) YEAR CONTRACT BETWEEN THE-CITY OF PORT ARTHUR AND SCODELLER CONSTRUCTION OF WIXOM, MICHIGAN FOR- CRACK SEALING OF CONCRETE AND ASPHALT PAVEMENTS ON A UNIT COST BASIS FOR VARIOUS CITY FUNDED AND COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDED STREET PROJECTS; PROPOSED FUNDING: STREET DIVISION ACCOUNT 001-1203-531.36/51/86 AND CDBG STREET PROJECT ACCOUNTS. WHEREAS, periodically the City requires the services of a contractor to seal cracks in concrete and asphalt pavemeht for various projects; and, WHEREAS, the City advertised in the Port Arthur News on February 7, ZOSO and on February 14, 2010 for said services; and, WHEREAS, five (5) bids were received and opened on February 24, 2010 for the above referenced Contract and have been evaluated by the Public Works staff and -Pureifiasing-Manager;-now, therefore; a BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the City Council of the City of Port Arthur hereby awards the bid for a one (1) year contract for crack sealing of concrete. and asphalt pavements to the lowest responsible bidder, providing the greatest value to the city, to wit: Scodelle~ Construction of Wixom, Michigan as shown on Exhibit "A" attached hereto and made a part hereof; and, P.R. No. 15821 Page 2 THAT. the Mayor and City Manager of the City of Port Arthur are hereby authorized and directed to execute on behalf of the City, a Contract between the City of Port Arthur and Scodeller Construction for a one (1) year Contract for crack sealing of concrete and asphalt pavements on various streets in the City of Port Arthur, Texas; and, THAT the contract is awarded on a UNIT COST BASIS, as shown on Exhibit "B" attached hereto and made a part hereof by reference, a complete copy of which is available for review in the office of the City Secretary; and, THAT said Contract is an exact duplicate of a standard form Federally Funded Construction contract except for the. changes described in the Certificate of Standard Form, a copy of which is attached as Exhibit "C" and is hereby incorporated by reference, and said changes are here approved; and, THAT payment bonds will be required if the individual project exceeds $50,000 and performance bonds will be required if the individual project exceeds $100,000 per Section 2253.021 of the Government Code; and, THAT, Scodeiler Construction of Wixom, Michigan shall sign this resolution agreeing to the terms thereof; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. z P.R. A prospective bidder must meet the following requirements: 1. Be able to comply with the required or proposed delivery schedule. 2. Have a satisfactory record of performance. 3. Be engaged in a full time business and can assume liabilities for any performance or warranty service required. 6. The City Council shall not awazd a contract to a company that is in.aneazs in its obligations to the City. 7. No payments shall be made to any person of public moseys under any contract by the City with such person until such person has paid all obligations and debts owed to the City, or has made satisfactory arrangements to pay the same. Any interpretations, corrections or changes to the ITB and Specifications will be made by addenda. Sole issuing authority of addenda shall be vested in the City of Port Arthur purchasing Manager. Addenda will be mailed to all who are known to have received a copy of the ITB. DELINQUENT PAYMENTS DUE CYTY: The City of Port Arthur Code of Ordinances prohibits the Crty from granting any .license, privilege or paying money to any-one owing delinquent taxes, paving assessments or any money to the City until such debts are paid or until satisfactory arrangements for payment has been made. Bidders mus4 complete and sign the AFFIDAVIT included as part of this ITB. QUANTITIES: Quantities shown aze estimated, based on projected use. It is specifically understood and agreed that these quantities aze approximate and any additional quantities will be paid for at the quoted price. CONTRACTOR'S ~ OBLIGATIONS: The Contractor shall grid will, in good workmanlike manner,perfo;m all work and fiirnish all supplies and materials, machinery, equipment, facilities and means, except as herein otherwise expressly specified, necessary or proper to perform and complete ail the work required by this Contract, in accordance with the provisions of this Contract and said specifications. The apparent silence of these specifications as to any detail or to the appazent omission from it of a detailed description concerning any point shall be regazded as meaning that only the best commercial practices aze to prevail. Page 6 of I S While the purpose of the specifications is to indicate minimum requirements in the way of capability, performance, constnzction, and other details, its use is not intended to deprive the City of Port Arthur the option of selecting goods which may be considered more suitable for the purpose involved. ' In the event of conflicts between the written bid proposal and information obtained verbally, the vendor is specifically advised that the written bid proposal will prevail in the determination of the successful bidder. Under the Title VI of the Civil Rights Act of 1964, no person shall, on the grounds of race, color, or national origin,. be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance. TERMINATION FOR CAUSE: If, through any cause, the Contractor shall fail to fulfill in a timely and proper manner his obligations under this contract, or if the Contractor shall violate any of the covenants, agreements or stipulations of this wntract, the City shall thereupon have the right to terminate this contract by giving written notice to the Contractor of such termination and specifying the effective date thereof, at least fifteen (i5) days before the effective date of such termination. Notwithstanding the above, the Contractor shall not be relieved of liability to the City for damages sustained by the City by virtue of any breach of the contract by the Contractor, and the City may withhold any payments to the Contractor for the purpose of set-off until such time as the exact amount of damages due the City from the Contractor is determined. TERMINATION FOR CONVENIENCE: The City may temtinate this contract at any time giving at least thirty (3p) days notice in writing to the Contractor. If the Contract is terminated by the City as provided herein the Contractor_.~dll_baT~rzhe_se-~ice_that tt~arperformed up to the termination date. If this contract is Terminated due to fault of the Contractor, the previous paragraph hereof relative to termination shall apply. RELEASES ANID RECEIPTS: The City of Port Arthur before making payments may require the Contractor to famish releases or receipts for any or all persons performing work and supplying material or service to the Contractor, or any sub-contractors for work under this contract, if this is deemed necessary to protect its interests. CARE OF WORK: The Contractor shall be responsible for all damages to person or property that oceurs as a result of his fault or negligence in connection with the work performed until completion and final acceptance by the City. SUB-CONTRACTS: The Contractor shall not execute an agreement with any rsub-contractor or pemut any sub-contractor to perform any work included in this Contract until he has received from the City of Port Arthur written approval of such agreement. INSURANCE: All insurance must be written by an insurer licensed to conduct business in the State of Texas, unless otherwise pernutted by Owner. The Contract shall, at his own expense, purchase, maintain and keep in-force insurance that will protect against injury and/or damages which may arise-out of or result from operations under this contract, whether the operations be Page 7 of IS by himself or by any subcontractor or by anyone directly or indirectly employed by any of them, or by anyone for whose acts any of them may be liable, of the following types and limits I • Commercial General Liability occurrence type insurance City of Port Arthur, its officers, agents, and employees must be named as an additional insured): a. Bodily injury $500,000 single limit per occurrence or $500,000 each person/$SOO,000per occurrence for contracts of $100,000 or less; or Bodily injury $1,000,000 single limit per occurrence or $500,000 each person /$1,000,000 per occurrence for contracts in excess of $100,000; and, b. Property Damage $100,000 per occurrence regardless of contract amount; and, c. Mmimum aggregate policy yeaz limit of $1,000,000 for contracts of $100,000 or less; or, Minimum aggregate policy year ]unit of $2,000,000 for contracts in excess of $100,000. 2. Commercial Automobile Liability Insurance (Including owned, non-owned and hired vehicles coverage's). a: Minimum combined single limit of $500,000 per occurrence, for bodily injury and property damage, b. If individual limits aze provided, minimum limits aze $300,000 per person, $500,000 per occurrence for bodily injury and $100,000 per occurrence •for -Property damage. Contractor shall cause Contractor's insurance company or insurance agent to fill in all information required (including names of insurance agency, contractor and insurance companies, and policy numbers, effective dates and expiration dates) and to date and sign and do all other things necessary to complete and make into valid certificates of insurance and pertaining to the above listed items, and before commencing any of the work and within the time otherwise specified, Contractor shall file completed certificates of insurance with the Owner. None of the provisions in said certificate of insurance should be altered or modified in any respect except as.herein expressly authorized. Said CERTIFICATE OF INSURANCE Form should contain a provision that coverage afforded under the policies will not be altered, modified or canceled unless at least fifteen (15) days prior written notice has been given to the City of Port Arthur. Contractor shall also file with the City of Port Arthur valid CERTIFICATE OF INSURANCE on like form from or for all Subcontractors and showing the Subcontractor (s) as the Insured. Said completed CERTIFICATE OF INSURANCE Form (s) shall in any event be filed with the City of Port Arthur not more than ten (10) days after execution of this Contract. Page S of 15 NOTICE TO PROCEEID: Notice to Proceed shall be issued within ten (10) days of the execution • of the Contract by OWNER. Should there be any reasons why Notice to Proceed cannot be issued within such period, the time may be extended by mutual agreement between OWNER and CONTRACTOR. CELL PHONE OR PAGER: The Contractor must have a working cell phone or pager available Monday through Friday from 8:00 a.m. to 5:00 p.m. so that the City will be able to contact the contractor. Page9of]5 SPECIFICATIONS FOR CLEANING AND SEALING JOINTS ANID CRACKS FOR CONCRETE AND ASPFIALT PA\7EMENTS " 1. Description. Clean and seal joints and cracks in new or existing concrete and asphalt pavements. 2. Material. Use shot-poured robber sealant consisting of arubber-modified asphalt compound which, when heated to the manufacturer's recommended temperature, will melt to an appropriate consistency for pouring and then solidify when cooled to ambient temperatures. Contractor to fnrnish all materials, inc@nding the crack sealant material 3. Equipment. Use equipment that meets sealant manufacturer's recommendations. Use air compressors equipped with appropriate filters for removing oil and water from the air. For grooving cracks, use devices such asdiamond-blade random-cut saws or random-crack grinders, capable of following the path of the crack without causing excessive spalling or other damage to the concrete. 4. Construction. Before starting work, information from the sealant manufacturer showing recommended equipment and installation procedures will be provided by the City of Port Arthur, Texas. All equipment~and procedures will be subject to approval.. For concrete pavement, if the equipment causes damage to dowels, reinforcing steel, concrete, base, sub base, or sub grade, the Contractor shall repair the damage and change the procedure and equipment to prevent further damage. Remove existing preformed bituminous fber boazd material or other spacer material the 'full depth of the joint along with all other debris in the joint opening. Resize the joint sealant space by sawing to the width and depth shown on the City Standard Details to accommodate the type of sealant specified. Clean the surface by method approved and in accordance with the manufacturer's specifications before placing sealant. After cleaning, air-blast the joint to remove all dust. 2) Cracks. Unless otherwise specified, groove the crack at the surface so that a reservoir with a rectangulaz cross section is provided for the sealant. Clean joints and cracks with air blast cleaning or other acceptable methods to a depth of least twice the joint or crack width. -Page 10 of 15 B. Sealing. Place the sealant in accordance with the manufacturer's .recommended procedures. Apply the sealant to dry joint and crack surfaces unless otherwise recommended by the sealant manufacturer. Tool any sealant material that is not self leveling to force the sealant against the joint surfaces. 1) .Ioints. Place a backer rod in the joint opening at a depth of 5/8 inch to ~'/. inch below the surface to prevent the sealant from flowing through the joint and to hold the sealant at its required elevation unless directed otherwise. Do not place sealant in an expansion-type joint if surface temperature is below SS°F or above 90°F. - 2) Cracks. Apply sealant with a pressure nozzle. Do not place the sealant when the surface temperature is less than 40°F. Set the top of the sealant 118 in. to 1/4 in. below the pavement surface, with a minimum depth of sealant of.l/2 in. unless otherwise recommended by the sealant manufacturer. 5. Measuremeut. This Item will be measured by the foot of sealant placed. 6. Payment. The work performed and materials furnished in accordance .with this Item and measured as provided under "Measurement" will be paid for at the unit price. This price is full compensation for famishing all materials; sawing, routing, and cleaning and installing; disposing of debris; and equipment, labor, tools, and incidentals. 7: Projects will be performed on an as needed basis.
