RECOMMENDATION:
I recommend that the City Council approve Proposed Resolution No. 15827, approving
Memorandum of Understanding with. the Port .Arthur Independent School District
(PAISD) for participation in the construction of sanitary sewer improvements for the
new Staff Sergeant Lucian Adams Elementary School.
BACKGROUND:
PAISD is constructing the new Staff Sergeant Lucian Adams Elementary,,School on 9~'
Avenue, adjacent to 57"' Street. This location requires the construction of a lift station
and force main. In order to provide for future development for an area that does not
currently have sanitary sewer service, the City will pay. for upgrades to. the system in
excess of the school's needs. The cost of these upgrades will be passed along to future
developers who will connect. to this sewer. The City portion is $205,000 of the total.
cost of $524,019.
BUDGETARY/FISCAL EFFECT:
The City portion is $205,000 of the total cost of $524,019.
EMPLOYEE/STAFF EFFECT:
None.
SUMMARY
I recommend that the City Council approve Proposed Resolution No. 15827, approving
Memorandum of Understanding with the Port Arthur Independent School District
(PAISD) for participation in the. construction of sanitary sewer improvements for the
new Staff Sergeant Lucian Adams Elementary School.

A RESOLUTION APPROVING A MEMORANDUM.,. OF
UNDERSTANDYNG BETWEEN THE CITY OF PORT ARTHUR AND
THE PORT ARTHUR -INDEPENDENT SCHOOL DISTRICT FOR
PARTICIPATYON IN THE COST OF SANITARY SEWER SYSTEM
IMPROVEMENTS AT A COST OF $205,000.
. WHEREAS, the Port Arthur Independent School District (PAISD) is constructing
the new Staff Sergeant Lucian Adams Elementary School; and,
WHEREAS, in order to provide for future development, the City wishes to
participate in the • construction of ;the required sanitary sewer improvements; now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT the City Manager of the City of Port Arthur is hereby authorized. and
directed to execute the Memorandum of Understanding. with the Port Arthur

Independent School District, attached hereto as Exhibit A ., agreeing to pay $205,000
out of a total project cost of $524,019; and,
THAT, the cost of the City participation will be passed along to future
developments that will connect to these sanitary sewer improvements; and,
THAT,. a copy of the caption of this Resolution. be spread upon the Minutes of
the City Council.

Memorandum of Understanding or Agreement Between
Port Arthur Independent School District and City of Port Arthur
This Memorandum of Understanding (MOU) exists between Port Arthur Indepehdent School District
(PAISD) and the City of Port Arthur, Texas (CPA). This MOU is for the funding of the construction of a
new sanitary sewer lift station and force main. It is understood that the sanitary sewer lift station and.
force main will be constructed by PAISD to the current CPA and Texas Commission of Environmental
Quality (TCEO) standards. The sanitary sewer lift station and force main will serve the Staff Sergeant
Luciari Adams Elementary School and provide sanitary sewer service to an area of the City that currently
does not have public sanitary sewer service. -
The design of the sanitary sewer lift station and force main project will incorporate two (2) fifteen horse
power (15 hp) pumps, an eight foot (8') diameter wet well, a fifteen kilowatt (15 kw) natural gas fueled
generator and a six inch (6") high density polyethylene force main. Also included in the project is the
construction of approximately six hundred fifty feet (650') of fourteen inch (14") gravity sanitary sewer and
five hundred sixty feet (560') of twelve inch (12") water line with appurtenances. It is understood that
upon completion of construction, PAISD will convey ownership of the sanitary sewer lift station, gravity
sewer, waterline and force~main to CPA for all future maintenance and operation.
It is understood by PAISD and CPA that a Pipeline Crossing Contract must be executed by both parties
with Kansas City Southern Railway Company'for the installation of the six inch (6") force main. PAISD
agrees to pay the cost of the lifetime permit fee of Eighteen Thousand Seven Hundred Fifty Dollars
($18,750.00). CPA agrees to pay for and maintain insurance as required by the terms Pipeline Crossing
Contract. __
" The PAISD and CPA recognize the need and' future value offered by the construction of the Staff
Sergeant Lucian Adams Elementary School lift station and force main project. As a result of this
recognition, PAISD and CPA agree to share in the cost of the sanitary sewer lift station and force main
project. The total cost of the project is Five Hundred Twenfy Four Thousand Nineteen Dollars
($524,019.00). The CPA agrees to contribute Two Hundred Five Thousand Dollars ($205,000.00) as
its portion of cast for the project. The CPA agrees to pay their portion of the. project cost with a single
lump sum payment upon issuance of a Notide To Proceed (NTP) to the contractor. The anticipated date
of the NTP is May 10, 2010.
