No. 15836, authorizing approval of Amendment Three to the Texas Nurse-Family Partnership Program Ageement between the Health and Human Services Commission and. the City of -Port Arthur for aNurse-Family Partnership gant to delete certain reporting requirements. BACKGROUND This is the second yeaz since the establishment and operation of local Nurse-Family Partnership (NFP) progam to provide educational, health, guidance, and other resources for low-income, Medicaid eligible, first-time pregnant women during pregnancy, and during the first two years of their infant's life through visits by highly trained registered nurses. This gant has provided for five (5) full-time registered nurses, one full-time clerical support person, and .a maximum caseload of 100 families. Currently, the progam is servicing over 65 families. This contract amendment deletes the requirement for the monthly submission of the Individual Client Data Report. BUDGETARY AND FISCAL EFFECT None. STAFFING EFFECT None. ' SUMMARY It is recommended that the City Council approve P.R. A RESOLUTION APPROVING AMENDMENT THREE TO THE TEXAS NURSE-FAMILY PARTNERSHIP PROGRAM AGREEMENT BETWEEN THE HEALTH AND HUMAN SERVICES COMMISSION AND THE CITY OF PORT ARTHUR WHEREAS, the FY 2009-2010 contract between the City of Port Arthur and the Health and Human Services Commission for the Texas Nurse-Family Partnership program was approved by City Council on September 8,.2009, Resolution No. 09-395, with. a contract term of September 1, 2009 through August 31, 2010 to provide educational, health, guidance, and other resources for low-income,' first-time pregnant women during pregnancy, and during the first two years of their infant's life through visits by highly trained registered nurses; and, WHEREAS, this contract amendment will revises the reporting requirements by deleting the monthly submission of the Individual Client Data Report. NOW THEREFORE BE IT RESOLVED BY THE CTTY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Council of the City of Port Arthurhereby authorizes Amendment Three to the Texas Nurse-Family Partnership Agreement to delete the monthly submission of the Individual Client Data Report. Section 3. That, a. copy of the caption of this Resolution be spread upon the Minutes of the City Council. P. R. REPRESENTATIONS AND AGREEMENT OF THE PARTIES .............................. ...............................3 HHSC 529-08-0110-00008C HHSC 529-08-0110-000O8C COUNTY-OF TRAVIS STATE OF TE.rAS Amendment Three To the Agreement Between the Health & Human Services Commission And City of Port Arthur For The Texas Nurse-Family Partnership Program This Amendment Three ("the Amendment") to HHSC Contract No. 529-OS-0110-00008 (the "Agreement") is entered into between the Health and Human Services Commission ("HHSC") an administrative agency within the executive department of the State of Texas with offices at 4900 North Lamar, Austin, Texas and City of Port Arthur. (CONTRACTOR) with offices at 449 Austin Avenue Port Arthur, Texas, for the purpose of amending certain key terms of the Original Agreement. The Parties entered into an agreement (the "Agreement") for Services and Deliverables pursuant to RFP No. 529-OS-0110 with an original term of performance of September 1, 2008 through August 31, 2009. On April 29, 2009, the Parties modified the Agreement to incorporate changes to the Services and Deliverables to be provided by CONTRACTOR. These modifications were incorporated into Amendment One to the Agreement ' On September 27, 2004, the Parties modified the Agreement to incorporate changes to the Term of the contract and Services and Deliverables to be provided by CONTRACTOR. These modifications were incorporated into Amendment Two to the Agreement The Parties hereby agree to amend the Agreement, as amended, HHSC contract number 529-08-0I 10- 00008, subject to the following terms and conditions. The Parties agree that the modified terms and conditions will apply to the Services and Deliverables to be provided by CONTRACTOR unless further modified or amended by the Parties. Article 1. Authority and Objectives. Section 1.01 Authority. The Parties in accordance with Section 6.03(b) (3) of the Agreement execute this Amendment Three. This modification is also executed in accordance with Article VI of the NFP Agreement document, and Article 7 of HHSC's General Contract Terms and Conditions, attached as Exhibit C to the NFP Agreement document Section LOZ Objectives. HHSC awarded a grant to the City of Port Arthur to establish and operate a Texas Nurse-Family Partnership Program utilizing the program model developed by and in accordance with Nurse Family Partnership National Service Office. The purpose of this Agreement is to modify certain terms of the original Agreement to effectuate the maximum provision of program services. HHSC 529-08-0110-OOOOSC Section 1.03 .Modifications to Agreement The Contract is modified for the following purpose: • To revise Exhibit F Reporting Requirements Section 1.04 EffeMive Date. This Amendment is effective on the date of execution by the Health and Human Services Commission. Article 2. Amendment to the Obligations of the Parties ' Section 2.01 Modifiuations. (1) Amendment to Exhibit F Reportine Requirements • Delete Bullet 3 - `Submit Individual Client Data Report including data reported the previous month. This report shall remain cumulative iri its entirety. Article 3. Representations and Agreement of the Parses. The Parties hereto contract and agree that the terms of the Original Contract shall remain in effect and continue to govern except to the extent modified by this Amendment. By signing this Amendment, the Parties hereto expressly understand and agree that the Amendment is hereby made a part of the original Contract as though it were set out word for word therein. The Parties have executed this Amendment in their capacities as stated below with authority to bind their organizations on the dates set forth by their signatures. IN THE WITNESS HEREOF, HHSC and CONTRACTOR, have each caused this Amendmeut Three to the Agreement to be signed and delivered by its duly authorized representafive.
