RESOLUTION NO.
A RESOLUTION AUTHORIZING A RIGHT-OF-WAY
LICENSE AGREEMENT WITH HATCH CONSTRUCTION
FOR PROPERTY LOCATED AT 1629 WOODWORTH
BOULEVARD
WHEREAS, Hatch -Construction has - requested that it be
permitted to construct a wooden canopy/awning in front of the
building located at 1629 Woodworth Boulevard, as per the letter
attached hereto as .Exhibit "A"; and
WHEREAS, the columns will connect the sidewalk to the
existing .canopy, which currently overhands the City's right-of-
way; and
WHEREAS, the City Council finds that ,it will not be a
detriment to the public interest to enter into an Agreement with
Hatch Construction regarding the placement of the columns and
canopy within the public right-of-way; and
WHEREAS, said Agreement is also contingent upon Hatch
Construction's compliance with the City's sidewalk ordinance as
it pertains to the property located at 1629 Woodworth Boulevard.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble
are true and correct.

Section 2. That the -City Manager is herein authorized
to execute a Right-of-way License Agreement with Hatch
Construction, in substantially the same form as attached hereto
as Exhibit "B", as to construct a wooden canopy/awning in front
of the building located at 1629 Woodworth Boulevard, .said
agreement is contingent upon compliance with the City's sidewalk
ordinance/requirements.
Section 3. That a copy of the .caption of this
Resolution be spread upon the Minutes of-the City Council.

A.D., 2010, at a Meeting of the City Council of
the City of Port Arthur, by the following vote: AYES:

For good consideration, and inconsideration of my being the owner of the
commercial property located at 1629 Woodworth Blvd., Port Arthur, Tx, I,
the undersigned, hereby request an encroachment agreement with the City
of Port Arthur for this property. The property is in need of a wooden
canopy/awning for the restaurant that I am opening at this location. The
canopy will extend approximately 3 feet.
I am attaching a photo of the proposed canopy. I am asking that this
matter be resolved as soon as possible so that I can resume work on this
project and apologi2e for any inconvenience this matter has caused.
