The Port Arthur Zoning Board of Adjustment & Appeals will meet in regular session at
5:30 p.m., Thursday, May 13, 2010, in the City Council Chambers on the fifth floor of

The Zoning Board of Adjustment and Appeals is being asked to consider a variance for the
following lot(s)/tract(s) in the City of Port Arthur, Jefferson County, Texas.
VARIANCE WILL BE ON THE FOLLOWING LOT:

This site is located north of Rev. Dr. Ransom Howard Street (7th Street) and west of
Vicksburg Avenue. It is also known as east 34 feet of Lot 9, Block 209, Port Arthur Land
Company, A-053400, Port Arthur, TX 77640. The zoning is "LC" Light Commercial. Notices
were sent out in compliance with the Texas Local Government Code Section 211 as well as
the publication being done on April 28, more than 15 days prior to the public hearing.

RECOMMENDATION:
Staff has no objections to this request due to the hardship of the family not being able to
afford more land and both adjacent properties have houses. The house will fit on the
property with the correct setbacks on the sides. However, the City is looking at the
decreased width and a lot size of 4760 square footage; the 34 foot width will allow for a
legally non-conforming lot size with less than 40% lot coverage but not more than 37%
covered space.

Lot 5, Block. 45 as the shape presented leave the rest of Lot 5 unbuildable.

The house has been built, but to confusion, about an adjoining house being
demolished, builder thought the non-encroachment was suffice. However, the lot
coverage and documents for homeowner files shall be approved by the ZBA.
