AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE
RESULTS OF A GENERAL ELECTION HELD ON MAY 8, 2010 FOR THE
PURPOSE OF ELECTING THE MAYOR AND PROVIDING FOR A JOINT
ELECTION WITH THE PORT ARTHUR INDEPENDENT SCHOOL
DISTRICT
WHEREAS, the City of Port Arthur is a home rule city with a governing body composed of a Mayor and
eight (8) Councilmembers as delineated below:

WHEREAS, the term for the Mayor will expire in May 2010; and
WHEREAS, on February 9, 2010, the City Council adopted Ordinance No. 10-07 that called for a
General Election {for the purpose of electing the Mayor; and
WHEREAS, a submission was made on February 12, 2010 to United States Department of Justice for
preclearance under Section 5 of the Voting Rights Act; and
WHEREAS, on April 20, 2010, the City Council adopted Ordinance No.10-21 acknowledging that the

Sabine Pass Independent School District and the Sabine Pass PortAuthority had cancelled theirelections, and
combining the Order and Notice of Election with the acknowledgement that the Port Arthur Independent School
District will be a joint participant in the City of Port Arthur's General Election; and re-designating a Vietnamese
Translator for the May 8, 2010 General Election; and
WHEREAS, on April 20, 2010, the City Council adopted Ordinance No.10-22 as to the designation of
the Early Voting Ballot Board, Deputy Early Voting Clerks, and the Election Day Presiding Judges, Alternate
Presiding Judges and Clerks, for the May 8, 2010 General Election; and
WHEREAS, on April 20, 2010, the City Council adopted Ordinance No. 10-23 as to appointments of
Counting Station Representatives; and
WHEREAS, on March 9, 2010 at a Regular Meeting, the City Secretary certified the following
candidates as having filed for office:
For Mayor: Deloris "Bobbie" Prince
Oscar G. Ortiz
Willie "Bae" Lewis, Jr.
Lowra A. Reado
and
WHEREAS, on April 7, 2010, the United States Department of Justice indicated that they had no
objections to the election procedures for May 8, 2010 General Election; and
WHEREAS, in accordance with the Charter of the City of Port Arthur and the laws of the State of
Texas applicable thereto, a General Election was held on Saturday, May 8, 2010, A.D.; and
WHEREAS, the returns of said General Election have been made by Terri Hanks, City Secretary, to
the City Council of iihe City of Port Arthur, and the City Council has examined said returns; and
WHEREAS, the City Council has a duty to canvass the returns, pursuant to the Texas Election Code.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,
TEXAS:

Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the returns of said General Election and, after being canvassed by the City
Council, are found and declared to be true and correct. There were cast at said election for the respective
candidates the nurriber of votes as shown on the tabulated statements that are attached hereto and made part
hereof as Exhibit "A" and as delineated below:
For Mayor_

Section 3. That, based on the representations of Terri Hanks, City Secretary, that she conducted the
Election in accordance with state, local and federal law, and based on the presumption under the law that the
election .judges arf~ presumed to have done their duty, the City Council has determined that said General
Election was duly called, ordered, and held in accordance with the Laws of the State of Texas and the Charter
of the City of Port Arthur and Ordinance No. 10-07, that the Order ordering the General Election and the
returns thereof, have been made by the proper officials, and that the May 8, 2010 election resulted in the
election of the following:
Mayor: Deloris "Bobbie" Prince
Therefore, Deloris "Bobbie" Prince is hereby declared to be elected as Mayor of the City of Port Arthur.
That the term for the Mayor shall commence on the date that the candidate is duly qualified and shall expire in
May 2013, or until his/her successor has been elected and duly qualified.

Section 4. That City Council shall therefore be composed of the following members:

Section 5.. That the City Attorney shall send a certified copy of this Ordinance to the United
States Department: of Justice as to notify them of the results of the May 8, 2010 General Election.
Section 6. That this being an Ordinance for which publication is not required under the Charter of
the City of Port Arthur, it shall not be published, but shall take effect and be in force immediately from and after
its passage.
Section 7. That a copy of this Ordinance shall be spread upon the Minutes of the City Council.
READ, ADOPTED AND APPROVED on this 18th day of May, A.D., 2010, at a Regular Meeting of the
City Council of the City of Port Arthur, Texas, by the following vote:
