Ms. Russell informed the commissioners that their terms will expire on July 15, 2010. A
resolution will be submitted to the City Council of the City of Port Arthur for re-appointments.
The board will select another chair and vice-chair for the new two-year term.

BACKGROUND:
The Zoning Board of Adjustment and Appeals is being asked to consider a variance
for the following lot(s)/tract(s) in the City of Port Arthur, Jefferson County, Texas.
VARIANCE WILL BE ON THE FOLLOWING LOT:

:3844 S. MLK DR. 4.204 ACRES - RV HOUSING SPECIAL EXEMPTION
This site is located south of Highway 82 [AKA Martin Luther King Drive] (6 miles
east of B. Ellison Blvd and Bridge overpass). It is also known as Tracts 113 and 115,
D. Gahagen Addition, Pleasure Island, Port Arthur, TX 77706. The zoning is "HC" for
Heavy Commercial; this allows for two-family or single family housing, in addition
to Heavy Commercial uses. Notices were sent out in compliance with the Texas
Local Government Code Section 211 as well as the publication being done on June
19th more than 15 days prior to the public hearing.

RECOMMENDATION:
Staff has no objections to this request due to the sudden change in rules on
September 23, 2008 and planning not being informed of the change to prohibit RV's
from parking unless a house is being repaired or built. The dwelling will fit on the
property with the correct frontal/back setbacks; however the applicant is
requesting a year. The property will have to be replatted, as presently, there are two
tracts of land to construct a building on and the structure should lie on one
property.
BUDGETARY/FISCAL EFFECT: None
STAFFING/EMPLOYEE EFFECT: None
SUMMARY: The Zoning Board of Adjustment and Appeals is requested to approve
this special exemption for a RV to remain as the owner is willing to comply with the
law and build a house within a year. The flood zone elevation shall be the City
mandates for a foot or higher than that stated on the NFIP map.

This site is located east of 4th Avenue and south of Gulfway Drive. It is also known as
part of Lot 15B, Block 32, Beachway Addition and Lot 3L, Block 18, Lambert
Addition, Port Arthur, TX. The zoning is "2F" Two-family for Townhouse/duplex.
Notices were sent out in compliance with the Texas Local Government Code Section
211 as well as the publication being done on June 19th more than 15 days prior to
the public hearing.
Applicant - Excello Construction (Will Jeter)

RECOMMENDATION:
Staff has no objections to this request due to the property being sold by deed; hence,
two lots are overlapped and created a problem for the construction of this new
building. The second or third transaction of sale occurred in 1977 and the family
did not consult the city prior to construction of present home or the purchase of the
property. The new house will fit on the property with the side setback and frontal
encroachment, that does not affect the building or safety because prior to a permit
issued the non-conforming issues will be addressed with fire walls on the side, the
variance application for the covered driveway and a replat. The matter of the house
existing in an Interurban Railway right-of way (ROW) is not clear, expect when the
addition was been built the builder(s) possibly thought the vacant land was their
property, not understanding the matter of ROW or easements existing, yet not City
owned or themselves. Several other houses exit in this ROW while other sections lie
as part of roadway that could have been easements given to the City.
BUDGETARY/FISCAL EFFECT: None
STAFFING/EMPLOYEE EFFECT: None
SUMMARY:
The Zoning Board of Adjustment is requested to approve this lot with a side setback
less than 5 feet and stipulate a fire wall. Staff will allow the carport with off the
street parking and no cars extended into the road. In addition, applicant shall replat
two lots into one tract per Subdivision Rules.

Townhouse/duplex. Notices were sent out in compliance with the Texas Local
Government Code Section 211 as well as the publication being done on June 19tH
more than 15 days prior to the public hearing.

RECOMMENDATION:
Staff has no objections to this request because the lot is on the corner, the visibility
triangle and proper setbacks shall be met for the Zoning Code. The house will fit on
the property with the correct frontal/back setbacks, but on the side by (Colorado
Ave and 8th Street) the setbacks are negated by the need for 10 feet and 3 foot exist.
However, where other properties are adjacent to this building with less than the
required setback will have a firewall as to Code requirements.
