SUBJECT: A Resolution Approving Settlement in the Amount of $5,736.87 Made Against Texas
Windstorm Insurance Association (TWIA) as a Result of Wind Damage to the City's
Residential Properties due to Hurricane Ike (September 13, 2008)
COMMENTS
RECOMMENDATION:
I recommend approval of Proposed Resolution No. 16062 which authorizes settlement in the amount of
$5,736.87 made against Texas Windstorm Insurance Association (TWIA) as a result of wind damage to
the Pompeiian Villa Caretaker House, the Department Club Caretaker House, and the 3510 Lake Arthur
Residence. TWIA has offered a settlement in the amount of $5,736.87, less each per occurrence
deductible for the three (3) properties, making the final settlement $3,493.87, as follows:
• Pompeiian Villa Caretaker House $1,857.53 (less deductible of $542.00 / final $1,315.53)
• Department Club Caretaker House $2,414.47 (less deductible of $351.00 / final $2,063.47)
• 3510 Lake Arthur Residence $1,464.87 (less deductible of $1,350.00 / final $114.87)
This is considered a fair and reasonable settlement.
BACKGROUND:
On September 13, 2008, Hurricane Ike struck the City of Port Arthur. The City's three Residential
Properties suffered wind damage as a result. TWIA has offered a settlement of Actual Cash Value (ACV)
in the amount of $5,736.87, less deductibles, making the final settlement $3,493.87.
BUDGETARY /FISCAL EFFECT:
The funds received will be deposited in the appropriate account designated by the Finance Director.
STAFFING /EMPLOYEE EFFECT:
No effect on staffing levels:

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER
TO DO ALL THINGS NECESSARY TO EXECUTE THE SETTLEMENT
OF CLAIMS IN THE AMOUNT OF $5,736.87 MADE AGAINST
TEXAS WINDSTORM INSURANCE ASSOCIATION (TWIA) AS A RESULT OF
WIND DAMAGE TO THE CITY'S RESIDENTIAL PROPERTIES
WHEREAS, on September 13, 2008, Hurricane Ike struck the City of Port Arthur, resulting in wind damage to the
Pompeiian Villa Caretaker House, the Department Club Caretaker House, and the 3510 Lake Arthur Residence; and,
WHEREAS, as a result of the damage, a claim was filed with Texas Windstorm Insurance Association (TWIA); and,
WHEREAS, TWIA has offered to settle the three claims for the Actual Cash Value (ACV) in the amount of $5,736.87
less each per occurrence deductible for the three (3) properties, making the final settlement $3,493.87, as follows:
• Pompeiian Villa Caretaker House $1,857.53 (less deductible of $542.00 / final $1,315.53)
• Department Club Caretaker House $2,414.47 (less deductible of $351.00 / final $2,063.47)
• 3510 Lake Arthur Residence $1,464.87 (less deductible of $1,350.00 / final $114.87)
WHEREAS, this has been determined to be a fair and reasonable settlement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Manager is hereby authorized to do all things necessary to execute settlement in the amount
of $5,736.87, Tess each per occurrence deductible for the three (3) properties, making the final settlement $3,493.87 for the
claim against Texas Windstorm Insurance Association (TWIA).
Section 3. That, a copy of this Resolution be spread upon the minutes of the City Council.
READ, ADOPTED, AND APPROVED this day of , AD, 2010, at a Meeting of the City
Council of the City of Port Arthur, Texas, by the following vote: AYES: Mayor , Councilmembers
