Alexander, MBA -HCM, Health Director DATE: August 31, 2010 SUBJECT: Proposed Resolution No. 16083 Contract Renewal between the City of Port Arthur and Lloyd Haggard, M.T. RECOMMENDATION: It is recommended that the City Council approve Proposed Resolution No. 16083, an Agreement for Professional Services between the City of Port Arthur and Mr. Lloyd Haggard, M.T., to provide consultant services for the City's laboratory. BACKGROUND: Mr. Haggard functions as a consultant so that the City's laboratory can remain in compliance with CLIA to perform STD testing. Mr. Haggard has been a consultant since FY 2002. STAFFING/EMPLOYEE EFFECT: None. BUDGETARY EFFECT: Mr. Haggard will be reimbursed through grant funds appropriated in the FY 2011 Preventive Health grant. A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR INDEPENDENT PROFESSIONAL SERVICES BETWEEN THE CITY OF PORT ARTHUR AND LLOYD R HAGGARD FOR THE PROVISION OF CONSULTATION SERVICES FOR THE CITY'S LABORATORY . FUNDING IS AVAILABLE IN ACCOUNT NUMBER 101 - 1331 - 542.11 -00 (HG1011). WHEREAS, the City Health Department needs a Microbiologist to act as consultant for the laboratory; and, WHEREAS, the current consultant, Lloyd R. Haggard, Microbiologist, has provided services since 2002 and has agreed to continue to provide professional consultation services at an amount of $1,500 per month, not to exceed 12 hours per week; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF PORT ARTHUR: Section 1. That the facts and preamble are true and correct. Section 2. That the City Manager and Director of Health are hereby authorized to execute said Agreement, a copy of which is attached hereto as Exhibit "A ". Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Alexander, MBA -HCM irector of Health Services APPROVED AS TO FORM: Ae / �1/ CITY ATTO ir EXHIBIT "A" AGREEMENT FOR INDEPENDENT PROFESSIONAL SERVICES That this Agreement is made between the City of Port Arthur, Texas hereinafter referred to as "City" and Lloyd R. Haggard, M.T., a person certified to perform as a Medical Technologist. I. TERM OF AGREEMENT That this Agreement shall be for a period beginning September 7, 2010 and shall remain in force during the fiscal year of the Texas Department of Health Office of Public Health Practice grant which ends August 31, 2011. II. COMPENSATION That Lloyd R. Haggard, M.T., shall be paid Fifteen Hundred Dollars ($1,500.00) per month for laboratory consultant services rendered. The hours of work shall be mutually agreed upon by the Director of Health of the City of Port Arthur and Lloyd R. Haggard and shall not exceed twelve (12) hours per week unless approved by the Director of Health. Mr. Haggard will be considered an independent contractor for the City, and shall provide consultant services in compliance with guidelines of the Clinical Laboratory Improvement Act (CLIA). Such services shall be at the standard of care and expertise expected of Medical Technologists in the State of Texas. III. BENEFITS That all benefits resultant from this contract are delineated herein, and no other benefits promised by any City officer shall be binding on the City. The Director of Health Services may, depending on the benefit to the City and availability of funds, approve funds for training and /or conference attendance. IV. TERMINATION That this Agreement can be terminated with thirty (30) days written notice by either party. SIGNED AND AGREED TO on the day of , 2010. CONTRACTOR Lloyd R. Haggard, M.T.
