RECOMMENDATION
I recommend that the City Council approve Proposed Resolution No. 16072 authorizing the execution of
Change Order No. 2 to the contract between the City and PM Construction & Rehab, LP, of Pasadena, Texas,
in the amount of $39,233.71 for the Sanitary Sewer Rehabilitation by the Pipe Bursting and Sliplining
Methods, Basins EV75, PR78, LV49, LV56, & N127, Contract No. 8, City Project No. 404PB8. This change
order does not increase the contract time.
BACKGROUND
This project is for the rehabilitation of approximately 80,000 feet of sanitary sewer mains, plus every service
connection served by these main lines. This project has proceeded at a remarkable rate and is well below the
authorized funding due to savings on several line items in the existing contract. This proposed change order
addresses two additional `cost' items. The first is that we asked the contractor to upgrade certain service lines
from the specified SDR -26 PVC to a heavier Schedule 40 PVC. This change adds $26,388.12. The second
item provides pay items that were not in the bid schedule (but that were on the plans) for a DD #7 concrete
ditch crossing with casing. This items totals $12,845.59.
More importantly, the change order adds several additional line segments at no additional cost. During the
course of these projects, we have found seven new lines totaling about 9,000 feet that are eligible for this type
rehabilitation. All of these line segments are in SSES defined basins that require rehabilitation, and a couple of
these lines have current failures.
BUDGET/FISCAL EFFECT
Funds are available in City Bond/EDA Grant Fund No. 404 - 1625 - 532.83 -00, Project No. 404PB8.
STAFF/EMPLOYEE EFFECT
City staff and our consulting engineer, Arceneaux & Gates, will oversee this project.
SUMMARY
I recommend that the City Council approve Proposed Resolution No. 16072 authorizing the execution of

A RESOLUTION AUTHORIZING THE EXECUTION OF
CHANGE ORDER NO. 2 TO THE CONTRACT BETWEEN THE
CITY OF PORT ARTHUR AND PM CONSTRUCTION &
REHAB, LP IN THE AMOUNT OF $39,233.71 FOR THE
SANITARY SEWER REHABILITATION BY THE PIPE
BURSTING AND SLIPLINING METHODS PROJECT, BASINS
EV75, PR78, LV49, LV56, & N127, CONTRACT NO. 8,
ACCOUNT NO. 404-1625-532.83-00, Project No. 404PB8.
WHEREAS, the City is currently under an Agreed Order with the TCEQ to rehabilitate its
sanitary sewer system; and,
WHEREAS, there exists a need to reduce flows and eliminate sanitary sewer overflows in
our collection and treatment systems; and,
WHEREAS, on November 3, 2009, by Resolution No. 09 -506, the City Council awarded the
Sanitary Sewer Rehabilitation by the Pipe Bursting and Sliplining Methods, Basins EV75, PR78,
LV49, LV56, & N127, Contract No. 8, City Project No. 404PB8 to PM Construction & Rehab, LP in
the amount of $3,085,560; and,
WHEREAS, the City and its consulting engineer have discovered additional sewer lines in
need of rehabilitation, and have provided additional pay items for work that was omitted from the
bid documents; and,
WHEREAS, Arceneaux & Gates Consulting Engineers, Inc. requested and recommends
changes to the bid schedule as delineated in Change Order No. 2 in the amount of $39,233.71,
increasing the contract amount from $3,430,944 to $3,470,177.71, and not increasing contract time;
NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT the City Council of the City of Port Arthur hereby authorizes the City Manager to execute
Change Order No. 2 (attached as Exhibit "A ") to the contract between the City of Port Arthur and
PM Construction & Rehab, LP for the Sanitary Sewer Rehabilitation by the Pipe Bursting and

404PB8 in the amount of $39,233.71, increasing the contract amount from $3,430,944 to

THAT this Change Order No. 2 be sent to the TWDB for processing and approval; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.
