RECOMMENDATION
I recommend that the City Council approve Proposed Resolution No. 16053 authorizing the execution of
Change Order No. 3 to the contract for the Wastewater Treatment Plant Rehabilitation Project, Contract
No. 5, City Project No. 404WWT with ALLCO, Inc., of Beaumont, Texas, in the amount of $151,459.
BACKGROUND
As a part of the Agreed Judgment between the City and the Texas Attorney General's Office /TCEQ
Enforcement Division, we were required to have our WWTP's evaluated for deficiencies that have
caused, or may cause, violations of our effluent permit. The subsequent construction project is for the
rehabilitation of deficiencies noted during this evaluation inspection of our Main and Port Acres
WWTP's. During the award process, it became apparent that the bids were well above ARRA funding, so
we deleted several Alternate Bid Items in an effort to get closer to our grant amount. Unfortunately, one
of the associated items, the Main WWTP Sludge Thickener, has failed. Many of the minor repairs to the
unit remained in the Base Bid, but we deleted an Alternate Bid Item that included some major items that
also needed repairs, in hopes of getting funding from another grant source. The center drive mechanism
has failed. It appears the 50 year old bearing housing has collapsed, causing the unit to lean and not
operate. This unit is basically a 45 foot diameter concrete cylinder, with a conical bottom & center drain
that operates by rotating rake arms that pull settled sludge to the center, while clarified water overflows
the top and is directed to other treatment units. The center drive provides the rotation. With this unit out
of service, we are in violation of out TCEQ permit, and there is no redundant unit. We are making
arrangements to remove the rotating mechanism, the bridge to the center drive, and all rotating equipment
from the basin in an effort to manually remove sludge from the unit without causing serious operational
problems for the rest of the WWTP.
Instead of performing the minor repairs included in the Base Bid, we have asked ALLCO, Inc. to provide
pricing for replacement of the center pier, bridge, drive, scraper /skimmer, weirs, baffle, etc. The total
provided by the contractor includes the new equipment, plus reprioritizes their work to get this unit back
in order as soon as possible. That means they will have to make the emergency thickener tank
modifications, remove all piping & equipment, and manually clean out our sludge holding lagoon, Allco
will have to stop working on all other pay items to complete this priority item. Arceneaux & Gates
Consulting Engineers has reviewed this proposal and recommends Change Order No. 3 to complete this
work. While ALLCO has not asked for a time extension for this work, the change order includes a 41 day
time extension for inclement weather since the start of the project.
BUDGET/FISCAL EFFECT
We have already committed all of our available ARRA grant funds on current projects. Therefore, we will
utilize our existing bond funds that we allocated for this work before the grant became available.
STAFF/EMPLOYEE EFFECT
City staff and our consulting engineer, Arceneaux & Gates, will continue to oversee this project.
SUMMARY

CHANGE ORDER NO. 3 TO THE WASTEWATER
TREATMENT PLANT REHABILITATION PROJECT,
CONTRACT NO. 5, BETWEEN THE CITY OF PORT ARTHUR
AND ALLCO, INC., OF BEAUMONT, TEXAS, INCREASING
THE CONTRACT AMOUNT BY $151,459 AND CONTRACT
TIME BY 41 CALENDAR DAYS. ACCOUNT NO. 404 -1625-
532.83 -00, CITY PROJECT NO. 404WWT.
WHEREAS, the City is currently under an Agreed Judgment with the Texas Attorney
General's Office and the TCEQ to rehabilitate its sanitary sewer system; and,
WHEREAS, there exists a need to upgrade and rehabilitate our treatment plants in order
to bring them into permit compliance; and,
WHEREAS, subsequent to the rehabilitation work already initiated, the Main WWTP
Sludge Thickener failed; and,
WHEREAS, Arceneaux & Gates Consulting Engineers found this additional work is
required to meet the requirements of our Agreed Judgement, investigated remedies, and
requested a Change Order proposal from our contractor, ALLCO, Inc.; and,
WHEREAS, ALLCO, Inc. responded with an acceptable proposal and Arceneaux &
Gates Consulting Engineers, Inc. has reviewed the proposal and recommends Change Order No.
3 in the amount of $151,459, increasing the contract amount from $8,513,516 to $8,664,975, and
increasing contract time by 41 calendar days due to inclement weather; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT the City Council of the City of Port Arthur hereby authorizes the City Manager to
execute Change Order No. 3 (copy attached hereto as Exhibit "A ") to the contract for the

We have had numerous conversations with Calvin Prosen and Enviroquip, Inc concerning the
possibility of eliminating some of the scope of supply for the existing Gravity Sludge Thickener
and thus reducing the cost of the Proposed Change Order for the Gravity Sludge Thickener.,
Calvin has pointed out to us that upon removal of the existing gravity sludge thickener
mechanism, there are several components that may be reutilized in the final arrangement that
would be acceptable to the Engineer and hopefully acceptable to the City of Port Arthur, Texas.
We are please to propose the following for your consideration.
1. We will provide the following as new items, which shall be supplied as hop dip
galvanized, and delivered to the jobsite.
a, One New Access Bridge complete with galvanized steel grating and i
aluminum handrails and drive platform to accept the new drive assembly
provided in the base bid amount previously authorized in your Purchase
Order No. 006162. I
b. One New Center Pier to support the new drive gear arrangement.
c, One New Drive Cage Assemb! for attachment to the new drive ear
9 Assembly gear
arrangement and to rotate the sludge collections arms,
d. Two New Sludge Collection Arms for attachment to the new drive cage I
assembly. New Sludge Collection Arms to be complete with New Sludge
Plows and Squeegees.

e. All New Required Fasteners, and Drill -In Anchor Bolts, for the items listed
above (a thru d) plus the new drive assembly.
2. We will incorporate the following existing items into the proposed arrangement:
a. The existing stainless steel influent well will be re- utilized and we will
provide attachment to the New Access Bridge. (NOTE: The Influent Well
does not rotate and is utilized to support one end of the side feed:
arrangement Influent Feed Pipe.)' The existing Influent Well has a special
fitting for the distribution of the side feed which will be re- utilized.
b. The existing stainless steel ninety degree V -notch weirs will be re- utilized.
(NOTE: These weirs are thicker than normal weir plates and sealing
them against the existing reinforced concrete wall will be the responsibility
of Allco, Inc.)
c. The side feed Influent Pipe shall be the responsibility of AlIco, Inc., and
shall not be provided by ETT. The side feed Influent Pipe must span
between the existing wall pipe connection and the inlet connection on the
existing influent feed well. (NOTE: The existing side inlet influent feed'
pipe may be approved for re- utilization by the Engineer and the City of
Port Arthur.)
The net cost reduction for re- utilizing the existing items mentioned above is $ 35,000.00.
To keep this paperwork as simple as possible, we proposed to delete the cost reduction shown'
above completely from the original ADDER AMOUNT OF $ 155,990.00, Thus the new
REVISED ADDER AMOUNT WOULD BE $ 120,990.00, The net cost to Allco, Inc., would be
the same, although the savings are technically attributable to the Base Bid Item,
