BACKGROUND:
The Planning and Zoning Commission is being asked to consider a replat request for Lots 5
through 10, Block 27, to produce two tracts to become Tracts S-A (2710 Evergreen Drive)
and 5-B (4415 Alamosa Drive), Block 27, Griffing Residential Park Subdivision, City of Port
Arthur, Jefferson County, Texas. The total acreage is 2.537 and the property is located
north of 25th Street and east of Evergreen Drive. The zoning is "SF" for Single-Family. The
abutting zoning is single-family to the north, south, east and west. The property will be
sub-divided and sold by owner (Attachment).
Notices were sent out in compliance with the Texas Local Government Code Section 212. As
of, Tuesday, October 12, 2010, twenty-one (21) notices were mailed to adjacent property
owners within a 200 ft. radius; two (2) was returned as undeliverable. The planning
department has received several calls inquiring about the specifics of this case. The
publication was done in the Port Arthur News on Sunday, October 3, 2010, fifteen (15) days
prior to the public hearing.

RECOMMENDATION:
The planning staff has no objections to this replat request. The plat will be filed with the
County Clerk's office with the appropriate block and subdivision information, as provided

Mr. Brown,
This replat involves the recent past sell of the front house located at 2710 Evergreen. It
has been sold to a local business man who has made a substantial investment and plans to
finish the renovation of "MAROTTO COTTAGE" property. Due to the commercial
nature and undesirability of the two (2) commercial metal structures built over the rear
residence of the cottage; I have sold him only the house and I wili retain ownership of
these building. The new address of this property will become once a�ain a family(s)
residence or 4415 Alamosa St.
My husband father, the Late Dr. Luis Marroquin's mother, Guadalupe Marroquin, once
lived in the residence raised on this exact location I herein request to replat and remodel.
1'he replat #10-37 is essential for the completion and/or conversion of the main metal
structure to the residential address (4415 Alamosa). That existing front metal building is
already plumbed with a full restroom, a kitchen area that has cabinets with a sink and hot
and cold water. This structure was never fully reconverted to a residence, by previous
owner, because this replat was necessary to be in compliance with single family zoning.
This replat will accomplish the return of this commercial portion of the property back to
its legal designation i.e., residential.
Upon your approval the present owner, I, intend on completely renovating the front
structure to once again a family dwelling with its own gazages located in the rear.

The Planning and Zoning Commission is being asked to consider a replat request for part of
Lot 1 and all of Lot 2, Block 22, to produce two tracts to become Tracts 1-A (1129
ShreveportAvenue) and 1-B (738 Thomas Boulevard), Block 22, City of Port Arthur, Jefferson
County, Texas. The total acreage is 0.2294 and the property is located south of Thomas
Boulevard and west ofShreveportAvenue. The zoning is "MF"for Multi-Family. The abutting
zoning is as follows: north/east "2F" Two-Family and south/west "MF" Multi-Family. The
purpose of this replat is to divide part of two lots into two tracts for the construction of

BACKGROUND:
The Planning and Zoning Commission is being asked to consider a replat request for Lots 5
and 6, Block 9, Shortline Terrace Addition, to produce one tract to become Tract 5-A, Block
9, Shortline Terrace Addition, City of Port Arthur, Jefferson County, Texas. The acreage is
0.4042 and the property is located southwest of Fredrich Street and east of Ray Avenue (Port
Acres Area). The zoning is "SF" for Single-Family. The abutting zoning is single-family to the
north, south, east and west. The property is being used for the construction of a single-
family dwelling.
Notices were sent out in compliance with the Texas Local Government Code Section 212.
As of, Thursday, October 14, 2010, twenty-five (25) notices were mailed to adjacent
property owners within a 200 ft. radius; one (1) was returned as undeliverable. The
planning department has received one call inquiring about this case; however did not have
any opposition regarding this request. The publication was done in the Port Arthur News
on Sunday, October 3, 2010, fifteen (15) days prior to the public hearing.

BACKGROUND:
The Planning and Zoning Commission is being asked to consider a zoning district change
request for Reserve Tracts "B" (3.562 acres of land) and "C" (5.275 acres of land), Fairway
Estates. A separate zoning request has been submitted for each Tract. The applicant is
proposing specific categories of use to be professional offices, retail establishments
customarily located in a regional shopping center, and/or restaurants on both Tracts of
land located on either side of Jimmy Johnson Boulevard (75� Street), beginning about 85
feet east of Golfhill Drive on the north side of Jimmy Johnson and on the south side
bordering the small ditch leading to a water feature on the Babe Didrikson Zaharias
Memorial Golf Course. Both parcels end at a point marking the westernmost corner of the
Clubhouse parking lot. As an alternative to a general rezoning of the property to
commercial or light commercial, the Planning Department recommended that the
developers consider a zoning change to a Planned Development District that would permit
the proposed specific uses referenced above, subject to site plan approval, including
standard architectural standards. Opposition to a proposed zoning change several years
ago came primarily from residents on Golfhill Drive who argued that the property should
remain SF in order to maintain the original design feature of single-family residences
ringing the golf course. Any development of these two strips of property must take into
account numerous easements for utilities, including natural gas, drainage, electrical,
telephone and cable located on both sides of Jimmy Johnson. In addition, a 30-foot wide
United Gas Pipeline corridor runs through the southern edge of the property on the south
side of the roadway. This corridor contains at least one crude pipeline, one petroleum-
product pipeline and a natural gas line.
Notices were sent out in compliance with the Texas Local Government Code Section 212.
As of, Thursday, October 14, 2010, five (5) notices were mailed to adjacent property
owners within a 200 ft. radius; none (0) was returned as undeliverable. The planning
department has received three (3) letters of opposition regarding this case. The publication
was done in the Port Arthur News on Sunday, October 3, 2010, fifteen (15) days prior to the
public hearing.

RECOMMENDATION:
The planning staff has no objections to acceptance of this request; however, the following
recommendations and/or requirements should be considered: engineering and
architectural designs must accommodate all of'the easements, which are numerous, on this
property. The site plan submitted by the deve(oper includes the maximum number of curb
cuts that will be allowed by the City. In addition, the developer has allowed for adequate
off-street parking pursuant to the requirements from the City. Development of these two
Tracts of land will pose considerable design restrictions for any type of development,
especially for the tract on the south side of the street. An argument can be made that the
30-foot-wide pipeline easement precludes any residential development on the south side of
Jimmy Johnson. In addition, the limited number of curb cuts that will be allowed by the
City could also make residential development on both Tracts of land difficult. With all of
the above in mind, rezoning these two Tracts of land to a Planned Development District
might be the only feasible avenue for development to occur on these two tracts of land that
is in harmony with the surrounding neighborhood.

Mr. Ramirez asked, "Does this meet the requirements for Industrial?" Mr. Leger responded, "Yes,
the reason for the request is because the oversized building/warehouse being constructed will
not fit on a single lot.
Ms. Moore asked, "What will be stored in the warehouse?" Mr. Leger responded, "I don't know."
Atma LeBlanc moved to close publrc hearing; Fernando Ramirez seconded the motion.
Vote: All Yeas - motion passed.

Ms. Russell made a recommendation for approval of replat request R10-39;
Fernando Ramirez made a motion to accept the recommendation for approval of case RIO-

Fernando Ramirez made a motion to accept minutes as presented; Alma LeBlanc seconded

V. STAFF REPORT
• Ms. Russell stated, "In the continuing weeks the glossary should be submitted to the
Planning and Zoning Commission so that editing, updating and corrections can be made so
that it can be adopted as the commission sees best whether in whole or in parts. We figure
that at this point we needed to start somewhere such that the Ordinance be updated from its
20 year hiatus."
• The new elevation requirements as of May 2010, state that all elevation must be a foot above
what is shown on the map (Chapter 42).
