BACKGROUND:
The Planning and Zoning Commission is being asked to consider a replat request for Lots
22 and 23, Reserve 3 Reservation, to produce one tract to become Tract 22-A (1132 Rev.
Raymond ScottAvenue (A.K.A. KansasAvenue]), Reserve 3 Reservation, E.A. Laughlin & W.M.
Barrier Subdivision No. 3, City of Port Arthur, Jefferson County, Texas. The acreage is
0.1607 and the property is located south of West Thomas Boulevard and east of Rev.
Raymond Scott Avenue �A.K.A. Kansas Avenue]. The zoning is "2F" for Two-Family housing.
The property is being used for the construction of a single-family dwelling.
Notices were sent out in compliance with the Texas Local Government Code Section 212.
On Friday, October 22, 2010, nine (9) notices were mailed to adjacent property owners
within a 200 ft. radius. The publication was done in the Port Arthur News on Sunday,
October 17, 2010, fifteen (15) days prior to the public hearing.

Mr. Burton stated, "The report needs to be amended. "Instead of three (3) letters of opposition,
the number has changed to four (4) due to a letter being received on today, Monday, October 18,
2010."
Mr. Bradley stated, "In the original deed restrictions for the property, it is stated that reserve
tracts B and C may be used for the following: multi-family, townhomes, condominiums, single-
family and/or commercial."
Mr. Burton informed the commissioners that he was submitting a copy of the deed restrictions
for the record.
Mr. Cooksey stated, "The original dedication of this property was done in 1984, it is still on file
and still in effect at the County Clerk's office. The text of the original dedication describes the
process for bringing variances to the original plan, which includes a committee called the
Architectural Committee, as well as the homeowners association. These groups are to be
consulted and they alone are invested with the authority to grant variances to zoning."
Fernando Ramirez moved to close public hearing; Inell Moore seconded the motion.

Mr. Burton made a recommendation for approval of replat requests R10-37 and R10-40 through
R10-43;
Inell Moore made a motion to accept the recommendation for approval of case R20-37 and
RIO-40 through RIO-43; Fernando Ramirez seconded the motion.
Vote: All Yeas - Motion passed.
VI[I. Z10-07 AND Z10-08 - ZONING DISTRICT CHANGE REQUESTED - MOTION REQUIRED
Mr. Burton made a recommendation for acceptance of zoning district change requests Z10-07
and Z10-08;
Mr. Ramirez asked, "Does the request violate any of the zoning changes or any request for the
City and/or the State?" Mr. Burton responded, "No."
Fernando Ramirez made a motion to accept the recommendation of the Planning
Department for Z10-07 and ZIO-08; Inell Moore seconded the motion.
Vote: All Yeas - Motion passed.
