RECOMMENDATION:
! recommend that the City Cound~ approve Proposed Resolution No. 12928, authorizing Change
Orders 03, 04, & 05 to increase the contract amount by $3,084.88 to a new total of $286,282.03.
BACKGROUND:
A contract was awarded to MC-O for the construction of the Boardwalk Elevator Tower on 12 Hay
2004 with a notice to proceed as of 01 June. The original amount for this contract was
$286,197.15, which was reduced by $3,000 by Change Order 01 to $283,197.15. Subsequent work
and unforeseen requirements of the project have resulted in additional change orders that will
increase the contract by an amount of $3,084.88 to a new total of $286,282.03. These change
orders are attached to the resolution and are summarized below:
Change Order 03 - removed certain fixtures ($1,064.25)
Change Order 04 - install additional items for safety $4,004.48
Change Order 05 - add a grating over the sump $145.65
TOTAL $3,084.88
BUDGETARY/F?SCAL EFFECT:
Funding is available in account number 303-1603-591.89-00.

THE BOARDWALK ELEVATOR TOWER.
WHEREAS, a contract for construction of the Boardwalk Elevator Tower was
executed between the City of Port Arthur and Mc-O Construction of Beaumont, Texas
on May 12, 2004; and,
WHEREAS, the original contract amount of $286,197.15 was subsequently
reduced by Change Order No. 0! by $3,000 to $283,197.15; and,
WHEREAS, changes during construction have resulted in Change Order No. 03,
reducing the cost by another $1,064.25; Change Order No. 04 with an increase in cost
of $4,004.48, and Change Order No. 05 with a further increase in cost of $144.65,
resulting in a net increase in cost of $3,084.88 to a new total contract amount of
$286,282.03; and,
WHEREAS, these change orders are due to unforeseen circumstances and are
necessary to the timely completion of this project; and,
WHEREAS, approval of Change Order Nos. 03, 04, and 05 (attached as Exhibits
"A", "B", & "C") to increase the project budget by an amount of $3,084.88 to a new
amount of $286,282.03 is herein deemed an appropriate action; now, therefore,

Review of Resubmitted Change Order Requests
Dear Mr. Blackketter:
After my initial change order review on October 7, 2004, Mc-O Construction has agreed to all of my
corrections but has resubmitted on two of my recommendations. The two recommendations in question
concern the installation of the plywood above the elevator shaft and the installation of the gypsum board
at the top of the elevator shaft.
A proposed change order for the revised design for the cane detection barrier is submitted as $195.39,
for review, the original design would have cost $889.53. The $195.39 figure is reasonable and fair in my
opinion.
Mc-O Construction also submitted a proposed change order for installation of steel angles at the corner of
the versa lam beams. Regarding that request, I personally spoke with Van RaUiff with Ratliff Industries
and that cost shall be washed out and the owner will not be subject to that add.
The following breakdown includes clarifications from my October 7 letter thus comprising all outstanding
issues in Change Order No. 4.
1. Installation of pl.vwood above elevntor shaft
Mc-O Construction is requesting $990.33 to perform this work but it has been modified as described
herein. They have done a better job of explaining their labor hours and are requesting 22 hours at
$22.78 an hour. t have spoken to Wyman Ogden with Mc-O and he is acceptable to my suggestion to
reducing this figure to 16 hours and also to eliminating the scaffolding cost.
Revised breakdown:
Material: $225.00
Labor $22.78 @ 16 hours $364.48
Mark-up: ~88.42
Total: $677.90
2. Instnllntinn of gypsum board nt top of elevator shaft
Mc-O Construction is requesting $536.71 to perform this work but has been modified as described
herein.. Labor costs are better explained and they are requesting 15 hours at $22.78 an hour. I spoke
with Wyman and he has agreed to lower this figure to 12 hours and to eliminate the scaffolding cost.
Revised breakdown:
Material: $75.00
Labor $22.78 @ 12 hours $273.36
Mark-up: $52.25 ..
Total: $400.61
3. Installation of phone line to service elevator
Mc-O Construction is requesting a total of $1,433.55 to perform this work. After reviewing their
change order request, I have no objections.
4. Installation of fiber-cament board over exposed floor framing members
Mc-O Construction is requesting $317.40 to perform this work. This amount is approved with the
exception of a minor mathematical error which would make the correct amount $317.29.
5, Installation of cane detection barriers to satisfy, the Texas Accessibility. Standards
Use 2x6 treated material and attach the members to the face of the post at 5 ½ inches above the
concrete,

Mark-up @ 15% $25.49

6, Installaticm of 5'-0" section of handrail at the west side of the stair opening
It is reasonable to assume Mc-O Construction is requesting $979.80 to perform this work although
they have $993.00 listed in the opening sentence and $979.80 at the bottom of the equation. Under
the assumption that $979.80 is the correct amount of the change order request, there was a minor
mathematical error and the correct ar:count is actually $979.74. Otherwise I have no objection.

I for one can certainly understand your concern of the hours and appreciate that as a professional and an interested representative
of the City Of Port Arthur and Me-O Coustructiun that it is necessary to review and justify the hours in question.
l) Installation ofpl~'wood above elevator shaft
The scaffolding is not necessary for the placing of the studs and could only be used as a means to climb up into the joist.
The studs eun and will be placed by 1 eraflsman measuring and nailing while one craflsman cuts studs to length and
passes them to the other. This method will be the most economical approach.
With this in perspective I am sure that one must believe that the same would apply to installing the plywood and it does
not and this is the reasoning behind it.
· The placing of the plywood will require the scaffolding and at least three era~men. The craftsmen will not be able to
climb up in the joist for the plywood will have to be cut in four foot lengths and shoved between the joist by one
era~man on the ground and two up on the scaffold. The plywood will be fiat in this position and have to be rolled up
by craftsmen on each end. There is not enough room for the craftsmen and the plywood up in the joist at the same
time and scaffolding is needed.
· The scaffolding will aced to reach all four sides and the area in the stair wells will require special attention and be
labor intensive.
· The final consideration for the additional hours is that we are dealing with an elevated area and all material must be
transported by hand.
Break down of hours
· 6 mh- to place scaffolding ,cribbing and plywood to elevated area
· 6 mb. - to erect scaffolding and cribbing
· 10 mh - to install plywood on all four sides
I respectfiflly request that this explanation be given consideration and that the hours and scaffolding charges be allowed to read as
follows.
· Material $ 225.00
· Labor $22.78 ~ 22 hours $ 501.16
· Scaffolding $135.00
· Subtotal $ 861.16
· Mark-up ~ 15 % $129.71
· Total $ 990.33
4) Richard Schredl did mention that the top of the elevator could be used for placing the gypsum in the ceiling of the
elevator shafl and this will save some effort but Iiaesa additional steps are required.
· The elevator will have to be locked out at the second floor and at least two sections of scaffolding will be
required to reach the ceiling.
· The task to be performed will require three eraflsmen, two on scaffold one on the deck Cutting and passing
material.
· There will be two layers of gypsum required for fire proofing.
* The gypsum must be installed in such a manner that the edges are very tight in order to seal and fire proof
the elevator shaft.
* The gypsum must be sealed by taping and ftoating.
· Remove all materials from deck.
I have given due consideration to tho charges and am in agreement that they be reduced to read as follows.

I would like to request that consideration be given as to the angles that were installed at the corners of the versa lama
beams. The method of installation was discussed but a change order was never placed by Mc-O considering the amount of
time that has elapsed I would accept the charges for the angles and no labor for installation.
