A RESOLUTION SETTING PUBLIC HEARINGS AS TO THE DISANNEXATION AND RELEASE OF EXTRATERRITORIAL JURISDICTION AS REQUESTED BY THE TAYLOR LANDING HOMEOWNER'S ASSOCIATION. WHEREAS, the City of Port Arthur made a Limited Purpose Annexation along Taylor's Bayou, as denoted in Exhibit "A" (Ordinance No. 324), attached hereto; and WHEREAS, the City Council has been requested to disannex and release its extraterritorial jurisdiction, as denoted in Exhibit "B"; and WHERF~AS, the City can disannex, per the procedure denoted in Section 43.142 of the Local Government Code, and per Article I, Section 6, of the City Charter; and WHEREAS, the procedures require notice and hearings. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the public hearings for disannexation and will be held on January 4, 2005, at 8:30 a.m. and on January 18, 2005, at 5:30 p.m. The proposed date for disannexation shall be February 8, 2005. z .pr12957 Section 3. That the Taylor Landing Homeowner's Association shall pay for the costs of all notices that will be published in the newspaper. Section 4. ARTHUR, TEkAS, ALONG THE SABINE-NECHES CANAL AND THE NECHES RIVER: The'limits of ~he City of Port Arthur, Texas, for the limited purposes hereinafter named are hereby extended so as to include in said City the navigable stream and waters known as the Sabine Neches Canal and the land lying on both sides thereof for a distance of 2,500 feet from the thread of said canal from the present easterly or northeasterly ordinary boundary line Of said city in an easterly or northeasterly direction to the Junction of said Sabine-Neches Canal with the Neches River, the same be- ing a distance in an air line of less than twenty miles and being, to-wit: A distance of 6-2/3 miles, more or less; and said limits of said City of port Arbhur, Texas, are hereby further extended for the purposetaforesaid so as to include the navigable stream or waters known as the Noshes River and the land lying on both sides thereof for a distance of 2,500 feet from the thread of said river to the northwesterly boundary line of the Thomas F. Sec. 5..EXTENDING THE LIMITS OF THE CITY 0F pORT ARTHUR, TEXAS, ALONG TAYLOR'S BAYOU: The limits of the City of Port Arthur, Texas~ for the limited purposes hereinafter named are hereby extended so ae to include in said city the navigable stream and waters known as Taylor~s Bayou and the land lying on both sides thereof for a distance of 2,500 feet from the thread of said canal from the present westerly or southwesterly boundary of said city, and from the mouth or Junction of said Taylor's Bayou with the Port Arthur Ship Canal, and thence un said Bayou for m distance of 1S miles, measured in an air line from said mouth of said bayou, the same being a distance of 20 miles or less in an air line from said westerly or southwesterly boundary of said City of Port Arthur, Texas; provided, however, there ie excepted hereby from the limits and territory included with- in the above exbension of the limits of the City of Port Arthur, Texas, any and all lands, if any, 'which is alrewly a part of any other city or town corporation, whether incorporated under the general laws or special law, and any and all land at the time belonging to any .other city or town. Sec. 6. PURPOSES FOR V~ICH ~PUE LIMITS OP TH~E SAID CITY ARE EXTENDED AND SAID' TERRITORIES ~BOlrE DESCRII/ED AHE IN- CLUDED IN SAID CITY: The limi'ted purposes for which the limits of said City of Port Arthur, Texas, are extended, as hereinbefore set out, are mentioned andset forthiineaid Legislative act, which is hereby accepted and adopted as aforesaid, and are herein mentioned as followsi The Commission of said City of Pert Arthur, Texas, shall have theright, power .and authority to secure land Within the territory so added to said city by purchase, condemnation or gift for the improvement of the nav~ation of said navigable~ streams or waters, either by the United States or by said Oity, or by .any navigation or ether improvement district, and for the pur- pose of establishing and maintaining wharves, docks, railway terminals, side tracks, warehouses or any other facilities or aids whatsoever to either navigation or wharves; and for these purposes the corporate limits of said cities shall, upon passage of said (this) ordinance, be extended frem the existing limits so as to include all the .land added to said city by said ordinance, previded~ the said city shall have no right to tax the property over w~hi~h such boundaries are es extended, unless such property be within the line and within the limits of the general city bound- aries or limits; and provided further, that after the passage of said ordinance adding said territory to said city, said city shall have and exercise within said limits the fullest and most complete power of regulati6n of navigation and of wharfage and of wharfage rates and of all facilities, conveniences and aids to wharfage or navigation consistent with the constitution of this State, and shall further have authority by criminal ordinances or otherwise, to police the navigation of s~id waters and the use of said wharves and facilities and aids to wharfage and navi- gation, provided in all condemnation proceedings under this Act .... the same procedure s~all apply that now applies in condemnation of land by cities for the purchase of streets. Sec. 7. CONFLICTING ORDINANCES REPEALED: All Ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed in so far as the same are in such conflict and not otherwise. pUBLICATION: C~is ordinance shall be published once in the Evening News, the same being a newspaper published and haY- lng a general circulation in said city and shall take effect sd be of force on the~'date following said publication.
