Tyler, Chief of Police Date: January 7, 2005 Re: Proposed Resolution No//12992 Now that the Texas Rangers and the District Attomey's office have determined the criminal allegations lodged by the Port Arthur Police Association and CLEAT against three top Administrators in the Police Depamnent were "unfounded", I believe that a thorough investigation of this entire matter is warranted to determine what happened, why, what rules, if any, were violated, and what were the motivating factors behind this unfounded barrage. All things considered, I believe that it is in the City's best interest this matter be thoroughly investigated by an independent external source to determine relative facts and make such findings available to the City Council, City Manager and general public. A RESOLUTION AS' IT PERTAINS TO AN INVESTIGATION ~ TO THE INCIDENTS AT THE 400 BLOCK OF PROCTER STREET ON OR ABOUT DECEMBER 4, 2004 AND THE RESULTING PROCESSING THEREOF WHEREAS, it has been recommended by the City Manager that the City enter into a contract to investigate an incident on December 4, 2004, as to the appropriateness of the behavior of City officials including Elected officials, City Administrators, Police officers, other Police employees and other parties that may have been involved in this issue. This investigation should include the activities of December 4t~, and any activities up to the present date by any and all parties that may involve any violations of law, City Charter, City Ordinances, Police Department Rules and Regulations including conduct prejudicial to good order. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR= SeCtion 1. That the facts and opinions in the prea~ble are true and correct. Section 2.
