Proposed Ordinance 5489 is a budget amendment to provide funding for:
· West Side Drainage Projects $218,000
· West Side Street Infrastructure Development 200,000
$418,000
These projects will be funded from the funds that have been paid by the EDC for the
purchase of the West Side Industrial Park property.
This proposed ordinance also provides funding from the General Fund balance to increase
the City Manager's contingency account by $30,000. These funds are to pay for the
estimated cost of the police department investigation. The Finance Department budget is
increased $40,000 to fund additional audit costs.

ORDINANCE NO.
AN APPROPRIATION ORDINANCE AMENDING THE
BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER
1, 2004 AND ENDING SEPTEMBER 30. 2005
WHEREAS, in accordance with Article XII, Section 9. of the City Charter, the City Council may
make emergency appropriations from time to time; and
WHEREAS, the City Council may make budget amendments for emergencies under Section
102.009 and for Municipal purposes under Section 102.010 Local Government Code.
WHEREAS, on September 14, 2004 the City Council approved and adopted Ordinance 04-53
which appropriated the 2004-2005 budget; and
WHEREAS, on November 9, 2004, the City Council approved and adopted Ordinance 04-72 which
amended Ordinance 04-53; and
WHEREAS, on December 14, 2004, the City Council approved and adopted Ordinance 04-78,
which amended Ordinance 04-53.
WHEREAS, there have been unanticipated cost increases in the General Fund and Capitol
Improvement Fund.
WHEREAS, these amendments are necessary for municipal purposes to meet unusual and
unforeseen emergency conditions as delineated in Section 102.009 (c) Local Government Code.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR
Section 1. That the budgets for the General Fund Administration Department be increased by
$30,000 to fund an investigation of the police depamnent, and the Finance Department be increased by
$40,000 to fund increased audit costs.
Section 2. That Section 2 of the Budget Ordinance 04-053 be amended to read:
That there be and is hereby appropriated the sum of Thirty Seven Million, Seven Hundred Fifty One
Thousand, Eight Hundred Forty Seven dollars ($37,751,847) to the General Fund for the payment of the
operating expenses, and necessary Capital Outlay for the City Government for the following Departments
and uses:

Section 3. That the budget for the Capital Improvement Fund be increased by $418.000 to fund
two new west side projects from funds received from the Port Arthur Economic Development Corporation
for the purchase of property.
Section 4. That Section 18 of the Budget Ordinance 04-053 be amended to read:
That there be and is hereby appropriated the sum of Three Million, One Hundred
Sixty Seven Thousand, Three Hundred Forty Three Dollars ($3,167,343) from the Capital Improvements
Fund for the following projects:
