Council Action Memorandum On Proposed Resolution No. 13021 Appointing
Negotiating Teams to Conduct Collective Bargaining with I.A.F.F. Local 397
and with the Port Arthur Police Association
COMMENT
I recommend that the City Council adopt Proposed Resolution No. 13021, which appoints
negotiating teams to conduct collective bargaining with I.A.F.F. Local 397 representatives and
with the Port Arthur Police Association representatives for the fiscal year beginning October 1,
2005.
BACKGROUND:
The City received written notice from the I.A.F.F. Local 397 and from the Port Arthur Police
Association of their intent to engage in collective bargaining regarding monetary and non-
monetary items for the fiscal year beginning October 1, 2005.
Currently, we are operating under a three year contract with the I.A.F.F. Local 397 covedng the
period October 1, 2002 through September 30, 2005; and under a two year contract with the
Port AYahur Police Association covering.the period October 1, 2003 through September 30, 2005.
Wdtten notice of their intent to bargain has been received (copies attached.)

SUMMARY:
I recommend that the City Council adopt Proposed Resolution No. 13021, which appoints
negotiating teams to conduct collective bargaining with I.A.F.F. Local 397 representatives and
with the Port Arthur Police Association representatives for the fiscal year beginning October 1,
2005.

A RESOLUTION APPOINTING NEGOTIATING TEAMS PURSUANT TO CHAPTER
174 OF THE TEXAS LOCAL GOVERNMENT CODE ANNOTATED, TO CONDUCT
COLLECTIVE BARGAINING ~qTH THE BARGAINING AGENTS OF
I.A.F.F. LOCAL 397 OF THE CITY OF PORT ARTHUR FIRE DEPARTMENT
AND THE PORT ARTHUR POLICE ASSOCIATION OF
THE CITY OF PORT ARTHUR POLICE DEPARTMENT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,
TEXAS:
THAT, pursuant to Chapter 174 of the Texas Local Government Code Annotatect,
the following persons are hereby designated to conduct collective bargaining on behalf of
the City with representatives of I.AF.F. Local 397, the bargaining agent of the Fire Fighters
of the City of Port Arthur Fire Department: City Manager, City Attorney, Assistant City
ManagedDirector of Human Resources, Assistant Director of Human Resources, Fire
Chief, and Director of Finance; and,
THAT, pursuant to Chapter 174 of the Texas Local Govemmant Code Annotated,
the following persons are hereby designated to conduct collective bargaining on behalf of
the City with representatives of the Port Arthur Police Association, the bargaining agent of
the Police Officers of the City of Port Arthur Police Department: City Manager, City
Attorney, Assistant City Manager/Director of Human Resources, Assistant Director of
Human Resources, Chief of Police, and Director of Finance; and,
THAT, the City Manager is hereby authorized to designate a chief spokesperson;
and,

THAT, the City Manager is also hereby authorized to provide a suitable place for the
cellective bargaining sessions, and to provide such supporting City personnel as needed
by the City negotiation teams; and
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the
City Council.
