ORDINANCE NO.
AN ORDINANCE CANVASSING THE RETURNS AND
DECLARING THE RESULTS OF A RUNOFF ELECTION
HELD ON JUNE 25, 2 011 AS IT PERTAINS TO THE
POSITIONS OF COUNCILMEMBERS FOR DISTRICT 4 AND
POSITION 7
WHEREAS, on January 25, 2011, the City Council adopted
Ordinance No. 11 -06, providing for the conduct of the May 14, 2011
General Election for the purpose of filling the vacancies in
Districts 1, 2, 3, and 4, and for Positions 7 and 8; and
WHEREAS, on May 24, 2011, the City Council adopted Ordinance
No. 11 -26 that canvassed the results of the May 14, 2011 General
Election; and
WHEREAS, no candidate received a majority of all votes cast
for the offices of Councilmembers from District 4 and Position 7;
and
WHEREAS, pursuant to Ordinance No. 11 -26, the City Council
called for a Runoff for the purpose of electing the positions of
Councilmembers from District 4 and Position 7; and
WHEREAS, Ordinance No. 11 -26 indicated that the runoff would
be between Harold L Doucet and Warren Field for Councilmember for
District 4 and Derrick Freeman and Willie "Bae" Lewis, Jr. for
Position 7 at the June 25, 2011 Runoff Election; and

WHEREAS, pursuant to the returns and report filed by the
Acting City Secretary after the June 25, 2011 election, the Runoff
Candidates received the following votes:
For Councilmember District 4: VOTE TALLY
Harold L. Doucet \
Warren Field
For Councilmember Position 7: VOTE TALLY
Derrick Freeman \
Willie "Bae" Lewis, Jr.
WHEREAS, the City Council has a duty to canvass the
returns, pursuant to Chapter 67 of the Election Code.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are
true and correct.
Section 2. That the returns of said Runoff as it pertains to
the Election of the positions of Councilmembers for District 4 and
Position 7, after being canvassed by the City Council, are found and
declared to be true and correct. There were cast at said election
for the respective candidates the number of votes as shown on the
tabulated statements that are attached hereto and made a part hereof
as Exhibit "A ", with the following total votes per candidate:

For Councilmember Position 7 : VOTE TALLY

Willie "Bae" Lewis, Jr.
Section 3. That, based on the representations of Sherri
Bellard, Acting City Secretary, that she conducted the Runoff
Election in accordance with the law, the City Council has determined
that said Special Election was duly called, ordered, and held in
accordance with the laws of the State of Texas, the Ordinances of the
City, and the Charter of the City of Port Arthur, and that the Order
ordering the Runoff Election and the returns thereof have been made
by the proper officials and that the Runoff Election resulted in the
election of the following:
Councilmember District 4: Harold L. Doucet, Sr.
Councilmember Position 7: Derrick Freeman
Therefore, Harold L. Doucet, Sr., is hereby declared to
be elected as Councilmember from District 4. That the term
for the Councilmember for District 4 shall commence on the
date that the candidate is duly qualified and shall expire in
May 2014, or until his successor has been elected and duly
qualified.

Therefore, Derrick Freeman is hereby declared to be
elected as Councilmember from Position 7. That the term for
the Councilmember for District 1 shall commence on the date
that the candidate is duly qualified and shall expire in May
2014, or until his successor has been elected and duly
qualified.
Section 5.
That City Council shall therefore be composed of the following
members:

Section 6. That the City Attorney shall send a copy of
this Ordinance to the Justice Department as to notify them of the
results of the runoff election.
Section 7. That this being an Ordinance for which
publication is not required under the Charter of the City of Port
Arthur, it shall not be published, but shall take effect and be in
force immediately from and after its passage.
Section 8. That a copy of the caption of this Ordinance be
spread upon the Minutes of the City Council.
READ, ADOPTED AND APPROVED on this 5 th day of July, A.D.,
2011, at a Council Meeting of the City Council of the City of
Port Arthur, Texas, by the following vote: AYES:
