On June 22, 2004, the City Council reviewed proposed
Ordinance No. 5396 to disannex and release this area. This
ordmnance did nou pass. Attached is a new ordinance disannexing
and releasing this area.

AN ORDINANCE I~ELEASiNG A PORTION OF THE CITY'S
EXTRATERRITORIAL JURISDICTION AND DISANNEXING
A PORTION OF THE CITY'S LAND ALONG TAYLOR'S
BAYOU THAT IT HAD ANNEXED FOR A LIMITED
PURPOSE IN 1913; ALL AS REQUESTED BY THE
TAYLOR'S LANDING HOMEOWNER'S ASSOCIATION
WHEREAS, the City of Port Arthur made a Limited Purpose
Annexauion along Taylor's Bayou, as denoted in ordinance No. 324:
and
WHEREAS, the City Council has been requested by the Taylor's
Landing Homeowner's Association to release its exurauerritorial
jurisdiction and release a portion of uhe Limited Purpose
Annexation as described in Exhibit ~A# and as illustrated in
Exhibit ~B#; and
WHEREA~, the City can disannex, per the procedures denoted
in SecTion 43.142 of the Local Government Code, and per Article
I, Section 6, of the City Charter; and
WHEREAS, the procedures require notice and hearings; and
WHEREAS, the City Council adopted Resolution No. 04-416
which scheduled public hearings for January 4, 2005 and January
18, 2005; and
WHEREAS, the City Council held the public hearings on these
dates and received public comment.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:

receives a ~No Objection" letter from the Justice Department, and
(3) the date of the incorporation of a new city in this area as
proposed by the Taylor's Landing Homeowner's Association,
