RECOMMENDATION:
I recommend that Proposed Resolution No. 13032 be approved. This Resolution would
disannex the property on which Golden Pass LNG will be constructing their
regasification facility.
BACKGROUND:
The applicant has requested that approximately 901 acres of land be disannexed. This
land is the proposed location of the planned Golden Pass LNG regasification facility.
BUDGETARY/FISCAL EFFECT:
An in-lieu of contract will be negotiated with Golden Pass LNG
STAFFING/EMPLOYEE EFFECT:
None
SUMMARY:
I recommend that Proposed Resolution No, 13032 be approved.

RESOLUTION NO.
A RESOLUTION SETTING PUBLIC HEARINGS AS TO
THE DISANNEXATION OF PROPERTY AS REQUESTED
BY GOLDEN PASS LNG TERMINAL LP
WHEREAS, the City Council of the City of Port Arthur has been requested to disarmex this land,
as denoted in Exhibit "A"; and,
WHEREAS, the City of Port Arthur can disannex, per the procedure denoted in Section 43.142 of
the Local Government Code, and per Article I, Section 6, of the City Charter; and
WHEREAS, the procedures require notice and hearings; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT the facts and opinions in the preamble are true and correct.
THAT the public hearings for disannexation will be held on at March 29, 2005 at 9:00 am and on
April 12, 2005 at 7:00 pm. The proposed date for disarmexation shall be May 10, 2005.
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
READ, ADOPTED AND APPROVED this ___ day of March, A.D., 2005, at a Regular

We appreciate Mayor Ortiz Mayor Pro-Tern Beard, City Planning ManaDer Date Watson an(]
you taking the time to meet with Morris Crim and I on January 12. 2005 to discuss our proposed
Golden Pass LNG Project,
Per our discussion, this letter is to confirm our request for the initiation of the disannexat~on
proceedings by the City of Port Arthur for the two parcels of property as follows: 1 ~ the propose(]
~erminal site consisting of -476 acres of land plus - 175 acres of submerged lands totaling -651
acres for which GPLNG nas an opbon to purchase currently owne0 Dy Doornbos. et. at.
(referred to as "O~tion Property") and 2) approximately 250 acres owned Dy Golden Pass LNG
that is adlacent to the Option Proper~y t referred to as the "GPLNG Property").
Our objective is have both properties disannexed by the time of potential FERC permit approval
and a subsequem potential project approva aecmJon such that project construction on the site
could potentially begin immediately upon the approvals, Additionally, this would allow our
engineenng, design and permitting work Ior the proposed facihty to be progressed based on
~ndustrial codes and standards,
The current owners of the Option Property, Doornbos, et, al, have been apprised that the City of
Port Arthur will be initiating the disannexation orocess for both the aforementioned propedies.

property.
