Proposed Ordinance No. 5502
RECOMMENDATION
The Purchasing Division recommends that the City Council adopt Proposed
Ordinance No.5502, awarding a bid for the purchase of property at 401 Procter Street to
Mr. Frank Andrews in the amount of $2,155, with the stipulation that Mr. Frank Andrews
must remove or demolish the house from the property within sixty (60) days of purchase
and the house is sold "as is".
BACKGROUND
The Purchasing Division advertised in the Port Arthur News December 19 and
December 26, 2004 requesting bids for the purchase of property located at 401 Procter
Street. The Bid proposal was opened February 2, 2005 with one (1) bid submitted from
Mr. Frank Andrews.
BUDGETARY/FISCAL EFFECT
None
SUMMARY
The Purchasing Division recommends that the City Council adopt Proposed
Ordinance No.5502 awarding the bid for the purchase of property at 40l Procter Street to
Mr. Frank Andrews in the amount of $2.155, with the stipulation that Mr. Frank Andrews
must remove or demolish the house from the property within sixty (60) days of purchase
and the house is sold "as is". This bid proposal is the only bid and is in the best interest of
the City.

ORDINANCE NO.
AN ORDINANCE AWARDING A BID TO PURCIiASE
PROPERTY LOCATED AT 401 PROCTER STREET
TO MR. FRANK ANDREWS
WHEREAS, the City Council deems it is in the best interests of the citizens to
award a bid for the purchase of property located at 401 Procter Street, (lots 13 and 14,
block 132 City of Port Arthur Addition, City of Port Arthur, Jefferson County, Texas) to
Mr. Frank Andrews in the amount of $2,155, with the stipulation that the buyer must
remove or demolish the house from the property within sixty (60) days of purchase and
the house is sold "as is".
WHEREAS, the Purchasing Coordinator recommends awarding the bid for
purchase of property at 401 Proctor Street to Mr. Frank Andrews for $2,155 as the best
and most responsive bid.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF PORT ARTHUR:
.Section 1. THAT the facts and opinions in the preamble are true and correct.
Section 2. THAT the City Council award the bid for purchase of property at 401
Procter Street in the amount of $2,155 to Mr. Frank Andrews and that the house is sold in
its current "AS IS" condition and Mr. Andrews must remove or demolish the house from
the property within sixty (60) days of purchase.

Section 3. THAT the City Council authorizes the City Manager to execute a special
warranty deed for the sale of property located at 401 Procter Street as described in
Exhibit "A".
Section 4. THAT this special warranty deed shall be delivered once the house is
demolished or removed from the property and after the $2,155 is paid in full to the City.
Section 5. THAT a copy of the caption of this Resolution be spread upon the
minutes of the City Council.

RESERVATIONS FROM AND EXCEPTIONS TO CONVEYANCE AND WARRANTY: This
conveyance is made "as is" expressly subjecL 5o all easements, rights-
of-way, restrictions, covenants, and conditions and all exceptions
reservations, and conveyances of minerals and/or royalties, oil and
gas and/or mineral leases, affecting the above described property, and
to all zoning laws ordinances, rules and regulations of municipal
and/or other governmental authorities, but only to the extent that
same are in force and effect and relate to the above described
property. This conveyance is also made subject to all state and
federal laws and regulations, if any, affecting said property though
they may be unrecorded.
Grantor, for the consideration and subject to the reservations from
and exceptions to conveyance and warranty, grants, sells and conveys
to Grantee the property, together with all and singular the rights and
appurtenances thereto in any wise belonging, to have and hold it to
Grantee, Grantee's Heirs, executors, administrators, successors, or
assigns forever. Grantor binds Grantor and Grantor's heirs,
executors, administrators, and successors to warrant and forever
defend all and singular the property to Grantee and Grantee's heirs,
executors, administrators, successors, and assigns against every
person whomsoever lawfully claiming or to claim the same or any part
thereof except as to the reservations from and exceptions to
