RECOMMENDATION ~
I recommend that the City Council approve Proposed Resolution No. 13049 mending the engineering
contract between the City and Bob Shaw Consulting Engineers for servtces related ~o the desi~ and
construction phase services for the Wastewater Collection System Rehabilitation projects. This change order
increases the contract's not-to-exceed amount by $18,000 to $1,545,700.
BACKGROUND
In March 2000, City Council awarded an engineering contract to Bob Shaw Consulting Engineers for
professional services related to the Wastewater Collection System Rehabilitation projects. In October 2004,
the City Council approved the abandonment of Stilwell Blvd. between Procter Street and Lakeshore Dr./4th
Street in order for Lamar State College Port Arthur to construct a pedestrian mall. In order to maintain
existing utilities within the abandoned Stilwell Blvd. right-of-way, and construct planned drainage
improvements according to the City's Master Drainage Plan, we are working with LSCPA to obtain an
easement for these utilities. Our Wastewater Collection System Rehabilitation project already calls for the
replacement of the sanitaxy sewer line in this area, and we are also working on relocating/improving the water
line to coincide with LSCPA's recent water line improvements performed during their last two building
projects. Also, the City's Master Drainage Plan calls for a 30" storm sewer to alleviate the flooding problems
along Procter Street in front of LSCPA.
Since Bob Shaw has already performed the bulk of the field Work for the sewer project and will already a
resident project representative on site to inspect the work, we feel it is in our best interest to add the
additional design work to his current contract. Due to time constraints in getting all this work done during
the Surm~ner break, our plan is to add the storm sewer construction along Stilwell Blvd. to our current sanitary
sewer construction project. While we may be able to use T'~VDB bond funds for the design work, we will
have to fund the construction separately.
BUDGET/FISCAL EFFECT
This change order increases the contract's not-to-exceed amount by $18,000.00 to $1,545,700.
STAFF/EMPLOYEE EFFECT
City crews will install the water line and the storm sewer along Lakeshore Dr. to Stilwell Blvd. in order to
reduce construction costs. City staff will continue to monitor the progress of this project.
SUMMARY
I reconmlend that the City Council approve Proposed Resolution No. 13049 amending the engineering
contract between the City and to Bob Shaw Consulting Engineers.

CONSULTING ENGINEERS, 1NC. RELATED TO THE DESIGN AND
CONSTRUCTION PHASE SERVICES FOR THE WASTEWATER
COLLECTION SYSTEM REHABILITATION PROJECTS.
(INCREASES CONTRACT AMOUNT BY $18,000). FLrND NO. 426- ~
1625-532.53-00, PROJECT NO. 426002.
WHEREAS, the City Council of the City of Port Arthur has awarded the engineering contract
to perform design and construction phase services for the Wastewater Collection System
Rehabilitation projects as directed by Texas Commission on Environmental Quality (TCEQ), in
Resolution No. 00-269; and,
WHEREAS, Bob Shaw Consulting Engineers does hereby request authorization, in the
mount not to exceed $18,000.00, to perform additional services for the redesign and/or design of
sanitary and storm sewer in Stilwell Blvd.; and,
WHEREAS, Bob Shaw Consulting Engineers has provided a letter requesting said additional
services, dated Febmary 22, 2005 (Exhibit A), describing the proposed cost of the additional services
not-to-exceed $18,000.00; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, the City Manager of the City of Port Arthur be and is hereby authorized and directed
to approve the additional services required for this work in the Wastewater Collection System
Rehabilitation project, increasing the not-to-exceed amount by $18,000.00; and,
THAT this contract Change Order will be contingent upon TWDB funding approval; and,
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council..
