REQUEST:
The Port Arthur Independent School District is requesting a Specific Use Permit for a
Public Stadium in the Single Family Zoning District on their property on the northwest
comer of 9 Ave. and Staff Sgt. Lucian Adams Dr.
BACKGROUND:
PAISD is proposing to locate a 1,500 seat Junior Varsity stadium at this location.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission met on Monday, February 21, 2005 and
recommended that this request be denied. At the time that the Plamfing and Zoning
Commission heard this request it included upgrading the stadium to a 10,000 - 12,000
seat 5A stadium at some poim in the future. The Commission had concerns about the
noise, light and traffic impacts on the adjoining residential areas. They did not feel that
the applicant had addressed these concerns.
Subsequent to consideration by the Planning and Zoning Commission, the applicant has
made several modifications. (See attached letters from Steve Daylor, AIA of PBK
Architects and Hugh McMillan, P.E. of Healthy Resources Enterprise, Inc.)
1. Removed the upgrade to a 5A stadium from consideration.
2. Moved parking to the vicinity of the stadium.
3. Agreed to take steps that would reduce the impacts of light and noise on the adjacent
residential areas.
4. Agreed that Staff Sgt. Lucian Adams Dr. would be improved.
Due to the substantial change in the request, as outline above, it would seem appropriate
to ask the Planning and Zoning Commission to reconsider their recommendation. Prior
to reconsideration by the Commission I would expect the following additional
information to be provided:
1. What steps will be taken to reduce noise impacts on adjacent areas.
2. What steps will be taken to reduce light impacts on adjacent areas.
3. What improvements would be made to Staff Sgt. Lucian Adams Dr. and the
intersection of 94 Ave. and Staff Sgt. Lucian Adams.
If this request is sent back to the Planning and Zoning Commission for reconsideration it
would be heard on March 28, 2005. The School District has requested that this issue be
acted on as quickly as possible. If the Planning and Zoning Commission makes a
recommendation on March 28, 2005, the City Council could consider the Specific Permit
request at their meeting on March 29, 2005.
The PAISD also has requested site plan approval from the Commission for their complete
project as required under Section 23-300 of the Zoning Ordinance. The Planning and
Zoning Commission has tabled this request until action is taken on the Specific Use
Permit request. Another issue that has been raised by the Planning and Zoning
Commission is the legal authority of the Commission to act on a site plan request when
the request is submitted by other than the owner of the property or the properS' owner's
authorized representative. Since the school district has the power of imminent domain, I
have asked the City Attorney for an opinion on this issue [see attached memo).
The architect is aware of this issue and is trying to get clarification from the school
district on the time schedule for acquiring this property.

Dear Steve:
Please be advised that HRE will design the exterior lighting systems, including the lighting for the
football field, baseball field, softball field and tennis courts in such a manner that the lighting will be
contained within the boundaries of the school property so as not carry over into the adjacent
neighborhood. Furthem~ore, the speakers will also be engineered to direct sound to the bleachers and
minimize the sound carry over into the adjacent neighborhood.

Port Arthur Independent School District is no longer requesting a specific use permit for a 10.000-
12,000 seat public stadium at the above, mentioned project.
Port Arthur Independent School District is requesting the approval of the modified site plan for this
project. The modified site plan relocates the student parking from the front of the school to a location
west of the school building and adjacent to the athletic fields.
Attached is a letter from Healthy Resources. Consulting Engineers to address concerns regarding
athletic field lighting and sound system design.

HIGH SCHOOL SITE PLAN

As I have discussed w/th you, the PAISD is required to obtain site plan approval from the
Planning and Zoning Commission for the new high school complex. This is required
under Section 23-300 of the Port Arthur Zoning Ordinance. This site plan covers land
that is owned by the PAISD, land that they have a purchase agreement on and land that I
understand will be acquired under jlaqminent domain.
At what point in the purchase and condemnation process would the school district be
considered to have sufficient interest in the property to allow the Planning and Zoning
Commission to act on their request for site plan approval? Under Section 2.5-100 of the
Zoning Ordinance each application for an amendment is required to be made by a person
or corporation having a proprietary interest in the property. Would this requirement
apply to the requested site plan approval?
