Recommendation:
The Police Department recommends that the Port Arthur City Council adopt Proposed
Resolution No. 13072, authorizing the City Manager to apply and receive grant funds,
under a joint grant with the City of Beaumont and Jefferson County under the Justice
Assistance Grant (JAG.) This program replaced the LLEBG (Local Law Enforcement
Block Grant) Program which has been discontinued by the Federal Govemment.
Background:
The Federal Government has ended the LLEBG Program and replaced it with the Justice
Assistance Grant Program (JAG). This program is very similar to the LLEBG Program.
The City of Port Arthur must file a joint application with the City of Beaumont and
Jefferson County to obtain funding. There is no cash match with this program. The
funding allocation formula provides for the following breakdown of funding: City of
Beaumont $112,514, City of Port Arthur $38,571 and Jefferson County $$26,662 for a
total grant amount of $174,747. Last year under the LLEBG Program the City of Port
Arthur received funding of $26,710 with required cash match of $2,968. The new
program will give the Port Arthur Police Department a higher level of funds with no
required cash match. The formula for funding levels is set by the Office of the Governor
of Texas and includes crime rate. The City of Port Arthur experienced a steep drop in
Part I Crimes last year which impacted our formula funds. The City of Port Arthur and
Jefferson County will each have to inter into an Inter-local Agreement separately with the
City of Beaumont to receive the funds.
Budget/Fiscal Effect:
The grant will add $38,571 to the Police Department's budget. The City is not required
to provide a cash match as was the case under the LLEBG Program.
Staffing/Employee Effect:
This program will enable the Police Department to purchase additional equipment for the
officers.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO APPLY
AND RECEIVE GRANT FUNDS ALONG WITH THE CITY OF
BEAUMONT AND JEFFERSON COUNTY IN AN AMOUNT NOT TO
EXCEED $174,747 UNDER THE JUSTICE ASSISTANCE GRANT
PROGRAM
WHEREAS, thc City of Port Arthur may jointly apply for funds with thc
City of Beaumont and Jefferson County under the Justice Assistance Grant program;
BE IT RESOLVED BY THE CITY COUNCIL OF TIlE CITY OF PORT
ARTHUR, TEXAS:
TIlAT the City Manager is authorized to apply for and receive grant funds
wherein the City of Beaumont will receive $112,514, the City of Port Arthur will receive
$38,571 and Jefferson County will receive $26,662;
TItAT the City Manager is authorized to enter into an Inter-Local
Agreement with the City of Beaumont to receive these funds in substantially the same
form as attached as Exhibit "A"; and
THAT a copy of the caption of this Resolution be spread upon the
Minutes of the City Council of the City of Port Arthur.

2005 Byme Justice Assistance Grant (JAG) Program Award
This Agreement is made and entered into this day of, 200~, by and between The City of Port
Arthur, Texas acting by and through its governing body, the Port Arlhur City Council, hereinafter
referred to as the City of Port A~thur, and the City of Beaumont, Texas acting by and through its
governing body, the Beaumont City Council, hereinafter referred to as the City of Beaumont, both
of Jefferson County, State of Texas, witnesseth:
WHEREAS, each goveming body, in performing govemmeotal funotions or in paying for the performance
of governmental functions hereunder, shall make that pertormance or those payments from CU~Tent
revenues legally available to that paAy: and
WHEREAS, each governing body finds that the performance of this ,Agreement is in the best interests of
beth parties, that the undertaking will benefit the public, and that the division of costs fairly compensates
the pedorming party for the services or functions under this agreement: and
WHEREAS, the City Of Beaumont agrees to provide the City of Port Arthur $38,571 from the JAG award
for the Program: and
WHEREAS, the City ot Beaumont and the City of Port Arthur believe it to be in their best interests to
reallocate the JAG funds.
NOW THEREFORE, the City of Beaumont and tile City of Port Arthur agree as follows:
Section I.
The City of Beaumont agrees to pay the City of Port Arthur a total of $38,571 of JAG funds.
Section 2.
The City of Port Arthur egmes to use $38,571 for the Program until (date).
Section 3.
Each party to this agreement will be responsible for ils own achons in providing services under this
agreement and shall not be liable for any civil liability that may arise from the furnishing of the services by
the other party.
Section 4.
The parties to this Agreement do not intend for any third party to obtain a right by virtue of this Agreement.
Section 5.
By entering into this Agreement, the parties do not intend to create any obligations express or implied other
than those set out herein; further, this Agreement shall not create any righls in any party not a signatory
hereto.
