No. 5511 - March 29, 2005 Council Meeting Attached is P. O. 5511 amending the Election Orders for the Special Election and General Election of May 7, 2005, deleting the Sabine Pass Port Authority, the Sabine Pass Independent School District, and the Port of Port Arthur Navigational District as participants in the Joint Election, designating a new Central Counting Station Manager, designating Election Judges and Clerks, and making other changes in the election orders. AN OI~DINANCE AMENDING THE ELECTION ORDERS FOR THE SPECIAL ELECTION AND GENERAL ELECTION OF MAY ?, 2005, DELETING THE SABINE PASS PORT AUTHORITY, THE SABINE PASS INDEPENDENT DISTRICT, AND TEE PORT OF PORT ABT~u~t NAVIGATIONAL DISTRICT AS PARTICIPANTS IN THE JOINT ELECTION, DESIGNATING A NEW CENTRAL COUNTING STATION MANAGER, DESIGNATING ELECTION · ~umGES AND CLERKS, AND MAKING OTHER CHANGES IN THE ELECTION ORDERS WHEREAS, pursuant to Ordinance No. 05-08, the City ordered the May 7, 2005 General Election for the purpose of electing Councilmembers from Positions 1, 2, 3, and 4; and WHEREAS, pursuant to Ordinance No. 05-19, the City ordered the May 07, 2005 Special Election for the purpose of submitting propositions to the voters; and WHEREAS, the candidates for the Sabine Pass Port Authority, the Sabine Pass Independent School District, and the Port of Port Arthur Navigation District are unopposed and will not be included in the joint election; and WHEREAS, the City will therefore hold a joint election with the Port Arthur Independent School District; and, WHEREAS, it is necessary to designate Christopher Mouton as the Central Counting Station Manager instead of Larry Borel; and, WHEREAS, it is necessary to designate election judges and clerks; and, WHEREAS, if a need arises for an emergency appointment of Election Judges and other Election Officials and there is no time for the Council to convene to fill such vacancies for the May 7, 2005 General and Special Election, the appointments shall be made by the Mayor, and if he is not available, by the City Secretary, as provided by Section 32.007 of the Texas Election Code. NOW THEREFORE, BE IT OP. DAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the Joint Election will be with Port Arthur Independent School District. Section 3. That the combined election order for the Special Election and General Election is approved, as denoted in Exhibit "A and at the polling places listed in Exhibit "B". Section 4. That Christopher Mouton is hereby appointed as the Central Counting Station Manager instead of Larry Borel. Section 5. That there are hereby appointed the Judges, Alternate Judges, and Clerks shown on Exhibit "C". Section 6. That if a need arises for an emergency appointment of Election Judges and other Election Officials and there is no time for the Council to convene to fill such vacancies for the May 7, 2005 General and Special Election, the appointments shall be made by the Mayor, and if he is not available, by the City Secretary, as provided by Section 32.007 of the Texas Election Code. Ortiz, Mayor of the City of Pod Arthur, Texas, as authorized by the City Council, do hereby Order and give Notice of a General Election to be held in the City of Port Arthur, Texas, on Saturday, May 7, 2005, between the hours of 7:00 a.m. and 7:00 p.m., for the purpose of electing Councilmembers for Districts 1, 2, 3 and 4 The term of office of the Councilmempers from Districts 1, 2, 3 and 4 will be for three (3) years and until his/her respective successor shall have been elected and duly qualified. Candidates may file an application with the City Secretary for a place on the ballot beginning February 7, 2005 through March 7, 2005. I, Oscar G. Ortiz, Mayor of the City of Port Arthur, Texas, as authorized by the City Council, do hereby Order and give Notice of a Special Election to be held in the City of Port Arthur, Texas, on Saturday, May 7, 2005, between the hours of 7:00 a.m. and 7:00 p.m., for the purpose of submitting propositions to the voters, as delineated in Exhibit 'A-l". Said election shall be by Electronic Voting System as provided in Section 123.001 of the Election Code, Section 9.004, et. seq., Local Government Code and the City Charter. The location of each polling place is shown on Exhibit "S." PROPOSITION NO. FOUR: Shall the existing Section 4A Sales and Use Tax within the City of Port Arthur be utilized to promote or develop new or expanded business enterprises that create or retain primary jobs, including a project to provide public safety facilities, streets and roads, drainage and related improvements, demolition of existing structures, general municipality owned improvements as well as any improvements or facilities that are related to any of those projects and any other project that the Section 4A board in its discretion determines promotes or develops new or expanded business enterprises that create or retain jobs, which is a category of projects under Section 4B of Article 5190.6 Vernon's Texas Code Statutes? PROPOSITION NO. FIVE: Shall the existing Section 4A Sales and Use Tax within the City of Port Arthur be utilized for the promotion of development and expansion of affordable housing as defined under by 42 U.S.C. Section 12745, which is a category of projects under Section 4B of Article 5190.6 Vemon's Texas Code Statutes? PROPOSITION NO. SIX: Shall the existing Section 4A Sales and Use Tax within the City of Port Arthur be utilized for the development or improvement of water supply facilities, including dams, transmission lines, well field developments, and other water supply alternatives, which is a category of projects under Section 4B of Article 5190.6 Vernon's Texas Code Statutes? PROPOSITION NO. SEVEN: Shall the existing Section 4A Sales and Use Tax within the City of Port Arthur be utilized for the development and institution of water conservation programs, including incentives to install water- saving plumbing fixtures, educational programs, brush control programs, and programs to replace malfunctioning or leaking water lines and other water facilities, which is a category of projects under Section 4B of Article 5190.6 Vernon's Texas Code Statutes?
