Blackketter, P.E., Director of Public Works SUBJECT P.R. #16631 — Providing and Hauling of Soils Contract DATE 15 August 2011 RECOMMENDATION: It is recommended that the City Council approve Proposed Resolution No. 16631, authorizing the 3 year (2 renewal) of the contract for the providing and hauling of soils materials (Fill sand, 60/40, and Clay) to Redwine Enterprises, Inc. of Port Arthur, Texas. This service will be provided on an AS- NEEDED BASIS. BACKGROUND: This is 3 year (2 renewal) of an annual contract for the providing and hauling of soils for the Public Works Department and other City departments. Historically, the City landfill, the Streets Division, and Parks Department have been the major users of this service. The first year of this contract was awarded to Redwine Enterprises, Inc. for fill sand, 60/40, and clay. The contract included the stipulation that each year's unit price would be adjusted according to the Consurner Price Index category "Transportation ". This reflects a 3.1% increase based on the June 2010 and June 2011 (most recent month available) values. BUDGETARY /FISCAL EFFECT: Funds are provided in the Public Works Budget and other departmental budgets. Over the last 12 months, the all items index increased 3.6 percent before seasonal adjustment. The gasoline index declined sharply in June, falling 6.8 percent. While this decrease was the major factor in the seasonally adjusted decline in the all items index, the index for household energy declined as well. In contrast, the index for all items less food and energy increased 0.3 percent for the second consecutive month. The indexes for shelter, apparel, new vehicles, used cars and trucks, and medical care all continued to rise in June. The food index increased as well, although the 0.2 percent rise was the smallest of the year. The index for food at home increased 0.2 percent, with major grocery store food groups mixed. The indexes for fruits and vegetables and for meats, poultry, fish, and eggs both declined, and while the other major grocery store food group indexes all increased, none rose more than 0.6 percent. The 12 month change m the all items index remained at 3.6 percent. The change in the index for all items less food and energy edged up to 1.6 percent, its highest level since January 2010. The food index has increased 3.7 percent over the last 12 months while the energy index rose 20.1 percent. Chart 1. A RESOLUTION AUTHORIZING THE 3 YEAR (2 RENEWAL) FOR THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND REDWINE ENTERPRISES, INC. FOR PROVIDING AND HAULING OF SOILS ON A UNIT COST BASIS, WITH PRICES ADJUSTED ACCORDING TO THE TRANSPORTATION CONSUMER PRICE INDEX. FUNDING IS AVAILABLE IN ACCOUNT NO. 403-1274-533.59-02. WHEREAS, the City requires the services of a contractor to provide soils for various projects within the different departments; and, WHEREAS, on August 11, 2009, per Resolution 09 -364; the City entered into a one year agreement with the option to renew for two (2) additional years with Redwine Enterprises, Inc. for the Providing and Hauling of Soils; and, WHEREAS, the prices will be indexed by using the Consumer Price Index category "Transportation ", which reflects a 3.1% for this year, said unit price increase is shown in this year's agreement, attached as Exhibit "A "; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, the City Manager is hereby authorized to execute the third year of a contract attached hereto as Exhibit "A" for providing soil materials (fill sand, 60/40, and clay) with Redwine Enterprises of Port Arthur, Texas with the price adjusted according to the Consumer Price Index category "Transportation "; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. WITNESSETH: That, for and in consideration of, the payment terms, conditions, and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. Pursuant to Resolution No. 09 -364, the City entered into a one -year contract with the option of renewal for two additional years. The parties hereby agree to exercise said option for the third and final year. 2. The term of this Contract shall be from 31 August 2011 to 30 August 2012 . 3. During the term of this Contract, the CONTRACTOR will furnish at his own expense all of the materials, supplies, tools, equipment, labor, and other services necessary to connection therewith, excepting those supplies specifically not required of CONTRACTOR in the Specifications. 4.
