RE: Proposed Ordinance No. 6170 — An Ordinance Amending Sections 110 -91 and 110 -92 of
Article II of Code of Ordinance
BACKGROUND
The 2011 -2012 proposed budget includes the elimination of the minimum bill, a $1.00 increase in water
rates for consumption over 20,000 gallons, and a $0.50 increase in sewer rates for consumption over 20,000
gallons. It also includes a $0.50 increase in water and sewer rates for consumers outside of the City.
BUDGETARY EFFECT
The estimated increase in utility revenue generated by this increase is $1,500,000.

AN ORDINANCE AMENDING SECTIONS 110 -91 AND 110 -92 OF DIVISION 3
(SERVICE CHARGES AND BILLINGS) OF ARTICLE II (WATER) AND
SUBSECTION (a) AND (c) OF SECTION 110 -191 OF DIVISION 3 (SERVICE
CHARGES) OF ARTICLE III (SEWER) OF CHAPTER 110 (UTILITIES) OF
THE CODE OF ORDINANCES, CITY OF PORT ARTHUR; SAID
AMENDMENTS INCREASING WATER AND SEWER RATES AND
CHARGES REPEALING ALL ORDINANCES AND PARTS OF
ORDINANCES IN CONFLICT HEREWITH; AND DECLARING THE
EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
Section 1. Sections 110 -91 and 110 -92 of Division 3 (Service Charges and Billing) Article II
(Water) of Chapter 110 (Utilities) of the Code of Ordinances, City of Port Arthur, are amended in their
entirety to read as follows:
"Sec. 110 -91 Rate Schedule.
The rates and charges for furnishing water service by the City are fixed and established for the respective
purposes and kinds of service at the following charges, and rates:
(1) In the City.
(a) Quantity charge. This charge shall be based on the monthly cost of the water used per one
thousand (1,000) gallons plus the appropriate RTSC based on meter size from section a. above.

Every 1,000 gallons $4.40 per 1,000 gallons
Over the 20,000 gallons $5.4 per 1,000 gallons
All water must be metered through meters furnished by the City, or other methods that are
approved by written authorization by the City. All water rates above fixed and prescribed are for
water furnished through the regular water system and plant of the City.
(2) On contracts outside the City. Provided where municipalities and outside users have entered into a
formal written contract with the city, all rates and conditions shall be as established within the
specific contract.
Section 110 -92. Consumers outside City not having special contracts.
The rates, fees and charges for furnishing water service by the city are fixed and established for all persons
not on special contract with the city and who reside beyond the corporate limits of the city as follows:
(1) Readiness -to -serve charges (RTSC). This charge shall be based on the size of the water meter serving
the premises. For RV /trailers parks, this charge shall be based on the size of the water meter serving
the premises per each space in the RV/trailer park.

(2) Quantity charge. This charge shall be based on the monthly cost of the water used per one thousand
(1,000) gallons. Plus the appropriate RTSC based on meter size from Sub -part (1) above.

(3) Private fire protection. This charge shall be an additional monthly charge of thirty two and 38/100
dollars ($32.38) for private fire protection. Private fire protection costs shall be incurred by those
customers that now have or will have in the future adequate water supplied by the city for private fire
hydrants, private sprinkler systems or other private fire protection appurtenances, owned and
maintained by a water customer for fire protection and testing thereof and separate from any other
water system on that property. All water must be metered through meters furnished by the city or
other methods that are approved by written authorization by the city."
Section 2. Subsections (a) of Section 110 -191 of Division 3 (Service Charges) Article III (Sewer) of
Chapter 110 (Utilities) of the Code of Ordinances, City of Port Arthur, is amended to read as follows:
"Sec. 110 -191. Rate schedule; due date.
(a) The following rates are established for sanitary sewer services to be furnished by the City. Such
rates shall be charged and collected from all persons for services rendered.
(1) Residential, apartment houses, hotels, tourist courts, laundries, milk plants, office
buildings and stores.
Quantity Charge. This charge shall be based on the monthly sewer cost per 1,000 gallons
of water usage, as recorded by the water meter:

Over the 20,000 gallons $4.54 per 1,000 gallons
Section 3. Subsection (c) of Section 110 -191 of Division 3 (Service Charges) Article III (Sewer) of
Chapter 110 (Utilities) of the Code of Ordinances, City of Port Arthur, is amended to read as follows:
(b) The following rates are established for sanitary sewer services to be furnished to premises
outside the city:
(1) Residential, apartment houses, hotels, tourist courts, laundries, milk plants, office
buildings and stores.
Quantity Charge. This charge shall be based on the monthly sewer cost per 1,000 gallons
of water usage.
Quantity in gallons Quantity Charge
Every 1,000 gallons $9.59 per 1,000 gallons
Over the 20,000 gallons $10.09 per 1,000 gallons
Section 4. The above provisions are to be inserted in the Code of Ordinances, City of Port Arthur
Texas in the sequence required by their designation; and,
Section 5. All ordinances and parts of ordinances in conflict herewith are hereby repealed, but only
to the extent of such conflict; and,
Section 6. This being an ordinance not requiring publication, it shall be effective from and after
October 1, 2011; and,
Section 7. That a copy of the caption of the Ordinance be spread upon the Minutes of the City
Council.
READ, ADOPTED AND APPROVED on this the day of September, 2011 at a regular
meeting of the City Council of the City of Port Arthur, by the following vote:
