Attached is P. R. No. 13203 as it pertains to access for Truth
& Education. This was tabled at the July 19, 2005 Council Meeting.
An Exhibit "A" delineating the security precautions has been
attached. Also, it has been reiterated that this applies to access
by Truth and Education and their guests to Room 201 of the City
Hall annex. Mr. Mosely suggested the figure "up to $1,000" as to
replace the lock and key as noted in Section 5 of Exhibit

RESOLUTION NO.
A RESOLUTION AS IT PERTAINS TO ACCESS
FOR TRUTH & EDUCATION
WHEREAS, the City Council granted Truth & Education a
License to Use with access to a portion of Room 201 of the
City Hall annex, per Resolution No. 04-420 on December 14,
2004; and,
WHEREAS, Section 5.02 of the Agreement states the
following:
"5.02 LESSEE shall have the right of ingress and
agrees, from 8 a.m. to 5 p.m. on such days that the
Annex is open to the public. If CITY is contacted by
LESSEE after the normal business hours of CITY, for
the purpose of accessing the aforementioned location.
LESSEE agrees to reimburse CITY for the actual cost
of any City staff overtime involvement necessary for
this access. Nevertheless, LESSEE shall abide by
such security precautions as set by the City as to
preserve the assets, records, and facilities of the
City. Under no circumstances shall LESSEE make any
renovations without first notifying and seeking the
approval of the City."
WHEREAS, the City Council now deems it in the public
interest to delineate security precautions for after hour
access for Truth & Education Corporation to Room 201 during
after hours and on weekends.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PORT ARTHUR:

Section 1. That the facts and opinions in the
preamble are true and correct.
Section 2. That Truth & Education Corporation
personnel and their guests will be allowed access to Room
201 of the City Hall Annex during non-public hours on
weekends and on weekdays if they comply with the security
precautions as delineated in Exhibit
Section 3. That Truth & Education Corporation
shall also sign this Resolution agreeing to the terms
hereof.
Section 4. That a copy of the caption of the
Resolution be spread upon the Minutes of the City Council.

EXHIBIT "A"
Truth & Education will abide by the following security
precautions as it pertains to access to Room 201 of the
City Hall Annex during weekends or after hours:
(1) A key will be available at the Police Department to be
checked in and out by Stephen Mosely and by his
licensed broadcast engineer, Johnnie Allen.
(2) Truth & Education will be responsible for escorting
persons in and out of the City Hall Annex to Room 201.
(3) Truth & Education will keep a log as to who enters
City Hall, when they enter, and when they leave, with
a notation of their address, phone number and driver's
license number, if it is available.
(4) If Truth & Education is already in the premises prior
to or at 5:00 p.m., they can stay in the premises so
long as they note in the log who remained in Room 201,
and when they departed from the City Hall Annex.
(5) If Truth & Education loses the key, they will pay the
City up to $1,000 for the cost to replace the lock and
all the keys thereto.
(6) Truth & Education will notify all guests that they are
not allowed access to any offices or facilities of the
City Hall Annex or to City Hall, except as to Room 201
of the City Hall annex and the adjacent restroom.
(7) This access can be immediately suspended by the City
Manager or his designee if a security breach occurs,
which shall be promptly reported to the City Council.
