Blackketter, P.E., Director of Public Works SUBJECT P.R. #16726 — CO -02 — Excavators for Storm Sewer Improvements Along Procter Street DATE 06 October 2011 RECOMMENDATION: I recommend that the City Council approve Proposed Resolution No. 16726, authorizing Change Order 02 to the contract with Excavators & Constructors, Ltd. for Storm Sewer Improvements Along Procter Street, increasing the contract by the amount of $44,921.84 to a total of $844,621.64. BACKGROUND: The City Council previously executed a contract with Excavators for Storm Sewer Improvements Along Procter Street. The original amount of this contract was for $775,878, which was previously increased by Change Order 01 to $799,699.80. Change Order 02, in the amount of $44,921.84, is for additional work resulting from unforeseen conditions. The project engineer, Arceneaux & Gates Consulting Engineers, Inc., has reviewed the request, and recommends approval. In addition, the Texas General Land Office, the agency administering this grant, now requires that the City approve this change prior to their review and approval. BUDGETARY /FISCAL EFFECT: Funds are available in the grant project ORPROC, 141 - 1201 - 532.59 -00. EMPLOYEE /STAFF EFFECT: None. SUMMARY I recommend that the City Council approve Proposed Resolution No. 16726, authorizing Change Order 02 to the contract with Excavators & Constructors, Ltd. for Storm Sewer Improvements Along Procter Street, increasing the contract by the amount of $44,921.84 to a total of $844,621.64. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER 02 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND EXCAVATORS & CONSTRUCTORS, LTD. FOR STORM SEWER IMPROVEMENTS ALONG PROCTER STREET, INCREASING THE CONTRACT AMOUNT BY $44,921.84 TO A TOTAL OF $844,621.64. ORPROC, 141 -1201- 532.59 -00. WHEREAS, in Resolution 11 -120, the City entered into a contract with Excavators & Constructors, Ltd. for Storm Sewer Improvements Along Procter Street in the amount of $775,878; and, WHEREAS, the contract amount was previously increased by Change Order 01 to the amount of $799,699.80; and, WHEREAS, Excavators has requested Change Order 02 in the amount of $44,921.84, attached hereto as Exhibit "A" for unforeseen additional work; and, WHEREAS, this change must be approved by the City Council prior to review and approval by the Texas General Land Office (GLO), the grant administrator; and, WHEREAS, approval of Change Order 02 in the amount of $44,921.84, increasing the contract to a new total amount of $844,621.64, is herein deemed an appropriate action; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, Change Order 02 is herein approved and the City Manager is authorized to execute said Change Order; and, P.R. 16726 Page 2 THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
