Attached is P. R. No. 16746 authorizing the City
Manager to execute Amendment No. 1 to the contract between
South East Texas Regional Planning Commission and the City
of Port Arthur for the Texas Department of Housing and
Community Affairs (TDHCA Hurricane Ike Disaster Recovery
Program.
The amendment will extend the contract expiration
date from September 10, 2011 until March 10, 2012, and the
Scope of Work as to remove services and costs for Housing
Administration Costs, as these services were transferred
in -house at the South East Texas Regional Planning
Commission.
I have attached the October 12, 2011 letter from
Shanna Burke, Disaster Recovery Division Director of the
SETRPC for your review.

TREASURER Hurricane Ike Disaster Recovery Program services between the South East Texas

Mayor Regional Planning Commission and the City of Port Arthur. The amendment
City of Kountze extends the current contract past the September 10, 2011 end date to March 10,

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
AMENDMENT NO. 1 TO THE CONTRACT BETWEEN SOUTH EAST
TEXAS REGIONAL PLANNING COMMISSION AND THE CITY OF
PORT ARTHUR FOR THE TEXAS DEPARTMENT OF HOUSING AND
COMMUNITY AFFAIRS (TDHCA) HURRICANE IKE DISASTER
RECOVERY PROGRAM
WHEREAS, pursuant to Resolution No. 09 -476, the City of Port
Arthur entered into a contract with South East Texas Regional
Planning Commission (SETRPC) for activities to be undertaken with
CDBG Disaster Recovery funds; and
WHEREAS, it is deemed viable to amend the original contract by
and between the parties to extend the expiration date until March
10, 2012, and the Scope of Work as to remove services and costs for
Housing Administration Costs, as these services were transferred
in -house at the SETRPC.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. The facts and opinions in the preamble are true
and correct.
Section 2. That the City Manager is authorized to execute
Amendment number one (1) with South East Regional Planning
Commission herein and further described in Exhibit "A" attached
hereto.

Section 3. That a copy of the caption of this Resolution
shall be spread upon the Minutes of the City Council.

EXHIBIT "A"
AMENDMENT NO. 1
TO
CONTRACT BETWEEN
SOUTH EAST TEXAS REGIONAL PLANNING COMMISSION
(Sub- Recipient of the TDHCA CDBG Hurricane Ike Disaster Program) AND
THE CITY OF PORT ARTHUR, SUB - CONTRACTOR
The South East Texas Regional Planning Commission (SETRPC) and The City of Port Arthur do hereby
contract and agree to amend the original contract by and between the parties, effective September 11,
2009, for the purposes of administration of CDBG Hurricane Ike Disaster Program.
The parties hereto agree to amend the contract identified above so that Exhibit A, Hurricane Ike CDBG
Program City of Port Arthur Budget, of the original contract is replaced in its entirety with the new
Exhibit A, to this Amendment No. 1, hereinafter referred to as Exhibit A -1, and hereby made a part of this
Amendment No. 1.
The parties hereto agree to amend the expiration date identified in Section 3. "PERFORMANCE ", of the
original contract. The contract period, is hereby amended and modified to reflect a termination date of
March 10, 2012.
This Amendment No. 1 shall be effective September 10, 2012.
Except as amended and modified by this Amendment No. 1, all terms and conditions of the Contract, as
amended, shall remain in full force and effect.
Any further revisions to the Contract shall be by written agreement to the parities.

NOTE: The South East Texas Regional Planning Commission will have the following programs within
the City of Port Arthur: Demolition, Owner- Occupied Rehabilitation, Owner- Occupied Reconstruction,
Elevation and Single Family Rental Rehabilitation. Of these programs, the City of Port Arthur will only
be responsible for the costs associated with Demolition Activities.

Demolition Administration Costs $ 120,000.00
