RECOMMENDATION:
It is recommended that the City Council approve Proposed Resolution No. 13283 to renew an
Agreement for Professional Services between the City of Port Arthur and William D. George,
M.D., to provide professional services as the City's Health Authority.
BACKGROUND:
Dr. George has served as the City's Health Authority since 1995. He has agreed to remain as
the City's Health Authority for both the Health and Fire Departments. This agreement will be most
beneficial to the City in that it will provide for continuity of services.
STAFFING/EMPLOYEE EFFECT:
None.
BUDGETARY EFFECT:
A total of $36,000 annually will be paid to Dr. George for his professional services. This cost will
continue to be divided between the Health and Fire Department's budgets.
SUMMARY:
It is recommended that City Council approve P.R. No. 13283, Agreement for Independent
Professional Services with Dr. William D. George, as such agreement will allow Dr. George to
remain as the City's Health Authority for both the Health and Fire Departments.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE EXECUTION OF AN
AGREEMENT FOR INDEPENDENT PROFESSIONAL
SERVICES BETWEEN THE CITY OF PORT ARTHUR AND
WILLIAM D GEORGE, MD TO ACT AS THE CITY'S HEALTH
AUTHORITY FOR THE HEALTH AND FIRE DEPARTMENTS
WHEREAS, Dr. William D. George has been acting as the Health Authority for the
City of Port Arthur since August 1, 1995; and,
WHEREAS, Dr. George has agreed to renew the contract with the City of Port
Arthur to remain as the Health Authority for the Health and Fire Departments; and,
WHEREAS, the city will compensate Dr. George at $3,000 per month; now
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PORT ARTHUR:
THAT the City Manager and Director of Health are hereby authorized to execute
said Agreement, a copy of which is attached hereto as Exhibit, "A"; and,
THAT said Agreement is an exact duplicate of a City Standard Form Contract
except for the changes described in the Certificate of Standard Form Contract, a copy of
which is attached hereto as Exhibit "B" and is hereby incorporated by reference, and said
changes are hereby approved;
THAT a copy of the caption of this Resolution be spread upon the Minutes of the
City Council.

EXHIBIT "A"
AGREEMENT FOR INDI~PI~NDI~NT pROFI:~91ONAL SEEVICE$
This Agreement is made between the City of Port Arthur, Texas hereinafter referred
to as "City" and William D. George, M.D., a person licensed to perform the duties of Health
Authority, herein referred to as "Contractor."
I. TERM OF AGREEMENT
This renewal Agreement shall be for a period beginning October 1,2005, and shall
remain in force through September 30, 2006. Thereafter, this Agreement shall be renewed
annually at the discretion of the parties.
II. PROFESSIONAL SERVICES
As the Health Authority, the Contractor shall:
1) Administer state and local laws relating to public health within the City's
jurisdiction in accordance with Section 121.021 Texas Health and Safety Code, as
amended.
2) Do all things necessary to impl(~ment and enforce the law to protect the public
health.
3) Perform each duty applicable to the City's jurisdiction as prescribed by the Texas
Department of State Health Services (DSHS).
4) Establish, maintain, and enforce quarantine in the City's jurisdiction.
5) Aid the Texas Board of Health and other public health officials in relation to local
quarantine, inspection, disease prevention and suppression, birth and death statistics, and
general sanitation in the City's jurisdiction.
6) Report as necessary the presence of contagious, infectious and dangerous

7) Perform all acts for the Port Arthur City Health Department which are required
by law to be performed by a licensed physician or which if provided by a person other than
a licensed physician would constitute the unlicensed or unlawful practice of medicine.
8) Provide consultant services in policy, planning, procedure, administrative and
other matters to the Director of the Health Department as requested by said Director.
9) Provide Medical Director advisory services to the City's Fire Department First
Responders Program registered with the Department of State Health Services.
10) Meet with the City's Fire Department representatives on a monthly basis to
review emergency medical incidents, exposures and debriefings, establish and review
medical protocols, review and make recommendations concerning DSHS certifications and
continuing education.
11) Provide professional assistance to the City's Fire Department in administrative
matters before boards, DSHS, and the City Council on an as needed basis.
III. COMPENSATION
The Contractor shall be paid Three Thousand Dollars ($3,000.00) per month for
professional services performed as the Health Authority. The hours of Work sha!l be
mutually agreed upon by the Director of Health of the City of Port Arthur.
IV. LICENSUREILIABILITY INSURANCE
1) The Contractor shall provide proof of licensure to practice medicine in the State
of Texas.

2) The Contractor shall be covered under the City's liability insurance for services
performed as the Healt'h Authority.
IV. TERMINATION
This Agreement can be terminated with sixty (60) days prior written notice by either
party.
