! recommend that the City Council approve Proposed Resolution No. 13293, revising the scope of
the contract with Arceneaux & Gates Consulting Engineers, Inc. for the design and construction
phase services for the Pedestrian Boardwalk and Walking Trail project, increasing the budget for
these services by $32,700 to a total of $256,600.
BACKGROUND:
On December 9, 2003, the City entered into a contract with Arceneaux & Gates Consulting
Engineers, !nc. (Arceneaux) for the engineering design and construction phase services for the
Pedestrian Boardwalk and Walking Trail project, which is funded by a Texas Department of
Transportation (TxDOT) grant.
The original budget for this project was based on an estimated construction cost of $1,677,000, but
the lowest to construct the extension was $615,000 over budget. In order to bring the project
within the original budget, the City Council has previously approved reducing the scope of this
project.
Arceneaux has proposed to do the necessary redesign for an amount of $32,700.
BUDGETARY/FISCAL EFFECT:
Funding is available in CIP 202, 303-:~603-591.54-00.

CONTRACT DATED DECEMBER 19, 2003 BETWEEN THE C]~TY OF
PORT ARTHUR AND ARCENEAUX & GATES CONSULTING
ENGINEERS, 1*NC. OF PORT ARTHUR, TEXAS FOR REDESIGN OF
THE BOARDWALK EXTENSTON AND INCREAS]~NG THE BUDGET
FOR THIS ENGINEERi'NG SERVl~CE BY $32,700 TO A TOTAL OF
$256,600. CIP 202, 303-1603-591.54-00.
WHEREAS, on December 9, 2003, the City Council of the City of Port Arthur
authorized a contract with Arceneaux & Gates Consulting Engineers of Port Arthur,
Texas for the design and construction phase services in the amount of $188,900 for the
Pedestrian Boardwalk and Walking Trail project which is being funded by a Texas
Department of Transportation grant; and,
WHEREAS, the City Council approved a change of scope for the design of this
project, increasing the budget for engineering services by $35,000 to a total of
$223,900 in March 2005; and,
WHEREAS, the lowest bid for construction of this project was $615,000 over
budget; and,
WHEREAS, the City Council approved a redesign of the Pedestrian Boardwalk
and Walking Trail project reducing the scope to bring the project within the original
project budget; and,
WHEREAS, Arceneaux & Gates Consulting Engineers, Inc. is the design engineer
for this project and has submitted an estimate of $32,700 (see Exhibit "A'~ for the
redesign; now, therefore,

THAT, the facts and opinions in the preamble are true and correct; and,
THAT, revising the scope of services for the Pedestrian Boardwalk and Walking
Trail project and increasing the budget for engineering design and construction phase
services by $32,700 to a total of $256,600 (CIP 202, 303-1603-591.54-00) is herein
approved; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.

City of Port Arthur Boardwalk Redesign

Dear Mr. Blackketter:
We have reviewed the revised scope of the proposed project improvements. In general, the
revised project will eliminate the elevated boardwalk and replace it with a pedestrian route
along Waco Ave. and 4th Street, connecting with the proposed walkway near Shreveport
Avenue. We will inspect the existing sidewalk along 4th Street to determine if any part meets
the accessibility requirements under ADA and make recommendations for modification or
replacement of the walk.
From discussion with TxDOT, it is apparent that we will need to reissue the plans rather than
attempt to strikeout portions that no longer apply. The project control stationing will be placed
along the centedine of the new route as designed and the sheets will be cut from that new
alignment. We estimate that approximately 28 sheets from the original plans will be deleted
and approximately 40 sheets will either be created or modified as a result of the changes.
We propose to be compensated on the basis of rates defined in our current contract for this
project and will not exceed the sum of Thirty-two Thousand Seven Hundred Dollars
($32,700.00). We will begin work promptly after Notice to Proceed and complete the work in
approximately 75 days. We look forward to beginning this work for you.
