HomeMy WebLinkAboutPR13302: TEMP HOUSING FIRE DEP PORT ARTHUR FIRE DEPARTMENT MEMORANDUM TO: Stephen Fitzgibbons, City Manager FROM: John Avery, Deputy Fire Chief~ Uc~ DATE: October 21, 2005 SUBJECT: Proposed Resolution No. 13302 RECOMMENDATION The Fire Department recommends that the City Council approve Proposed Resolution 13302 authorizing the City Manager to execute a twelve (12) month lease agreement with Mobile Modular in the amount of $1,013.00 per month for the temporary housing of Fire Station Number 4. BACKGROUND As a result of Hurricane Rita, Fire Station Number 4, located at 5030 South Gulfway Drive in Sabine Pass, sustained substantial damage and is currently inoperable and uninhabitable. There is an urgent need to approve temporary housing of Fire Station Number 4 until a determination is made as to the nature of repairs to the facility at 5030 South Gulfway Drive. BUDGETARY/FISCAL EFFECT The costs, which are expected to be reimbursed, will be charged to the Hurricane Rita Fund, account 123-2300-901.51-00. STAFFING/EMPLOYEE EFFECT None. A RESOLUTION APPROVING A LEASE AGREEMENT WITH MOBILE MODULAR FOR THE TEMPORARY HOUSING OF FIRE STATION NO.4 DUE TO DAMAGES SUSTAINED TO THE PERM]~NENT FACILITY AT 5030 SOUTH GULFWAY DRIVE, SABINE PASS A RESULT OF HUP~ICANE RITA WHEREAS, As a result of Hurricane Rita, Fire Station No. 4 located at 5030 South Gulfway Drive in Sabine Pass has sustained substantial damage and is currently inoperable; and WHEREAS, there is an urgent need to approve a twelve (12) month lease agreement with Mobile Modular in the amount of $1,013.00 per month for the temporary housing of Fire Station No. 4 until a determination is made as to the nature of repairs of the normal facility. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Manager is herein authorized to execute a twelve (12) month lease with Mobile Modular in substantially the same form as attached hereto as Exhibit "A". Section 3. That a copy of the caption be spread upon the Minutes of the City Council. The extent of Mobile Modular's (Lessor's) responsibility is to ship the steps inside the modular building. Unloading the steps upon delivery and installation of the handrails is 1o be by the customer, as is disassembly of the handrails and leading at [he steps, belore the modular'is returned, -ir Mobile Modular performs this service, there is a charge of $30.00 per set of steps to unload and $30.00 per set of slaps to load_ If the steps are shipped separately from the modular building, there will be a separate delivery or pick-up charge. · Securing the s£epe to the modular, adjusting the steps to the threshold of lhe doo~ay, adjustment of the steps or landing height to meet local, state or federal requirements, maintenance of the steps or any other item not specifically indicated above is solely the responsibility or the Lessee. Mobile Modular advises the Lessee that they (Lessee) need to adjust and secure the exit way upon completion of the installation of the modular building as required to ensure the safety of the occupants of [he building. Mobile Modular does not warrant that the steps meet any local, state, or federal requirements or codes. Please note that it ia the L. easee's/Buyar's responsibility to ensure that steps or a ramp are provided for each building egresS. · In the event that the Lessee wishes to discontinue their use of the slaps prior to the expiration of the lease term and return of the building, the Lessee may elect to return th~ steps to Mobile Modular, have Mobile Modular pick-up the steps for a nominal charge, or store lhe steps on site, however rental will continue on the steps until their return to Mobile Modular. · Upon lease termination, the steps are to be returned to Mobile Modular in the same condition as supplied, normal wear and tear excepted, Lessee hereby indemnifies Lessor against any cost, expenses and damages, including attorney fees, which adse out of Lessee's failure to maintain and install the steps as stated above and any injury liability for step use by Lessee, Signature and Print Name Date and Company's Name
