HomeMy WebLinkAboutPR 16676: CALLING A PUBLIC HEARING FOR PUBLIC WATER SYSTEM IMPROVEMENTS MEMORANDUM CITY OF PORT ARTHUR UTILITY OPERATIONS DEPARTMENT TO: Stephen Fitzgibbons, City Manager FROM: Kelly Eldridge, Director of Utility Operations DATE: December 8, 2011 SUBJECT: Proposed Resolution No. 16676 RECOMMENDATION We recommend the approval of Proposed Resolution No. 16676 calling for a public hearing with regards to the proposed assessments along 63` Street for water system improvements. BACKGROUND The Utility Operations Department has received requests for public water system improvements along 63 Street in the Port Acres area for the provision of water service and fire protection to enable the construction of homes in this area. There is currently no public water system along 63 Street from Pat Avenue to just east of Diamond Avenue. The few existing homes in this area have no fire protection and domestic water service is generally provided by private line extensions across other properties. It is the land developer's responsibility to furnish water mains and fire hydrants to undeveloped areas of the city. Current City Ordinance requires fire hydrant to be within 600 feet of buildings. New construction would require adequately sized water mains and fire hydrants in order to get a building permit. The estimated cost for a public water line to serve this area is $56,100. Since this would serve several undeveloped, or partially developed, properties along this route and the cost is far too much for a single property owner to bear, we propose to assess all the affected properties. The Engineering Division has provided a list of affected properties, and the attached spreadsheet shows the proposed cost apportionment. We are still researching JCAD files and the few available maps of these properties to make sure the list is as accurate as possible. The estimate includes a looped 6" water main through the area with three (3) fire hydrants to provide fire protection for these residential lots. BUDGET /FISCAL EFFECT We can only assess 90% of the cost of the improvements or the difference of the properties' appraised value before and after the improvements. STAFF /EMPLOYEE EFFECT None. A RESOLUTION CALLING A PUBLIC HEARING WITH REGARD TO PROPOSED ASSESSMENTS FOR PUBLIC WATER SYSTEM IMPROVEMENTS ON 63 STREET FROM PAT AVENUE TO EAST OF DIAMOND AVENUE. WHEREAS, the City Council deems it in the best interest to make public water system improvements on 63 Street from Pat Avenue to east of Diamond Avenue; and, WHEREAS, the Director of Utility Operations has provided a letter, attached hereto as Exhibit "A ", outlining the scope of the project; and, WHEREAS, the scope of the project and estimates for the entire project are described in Exhibit `B" attached hereto; and, WHEREAS, the names of the property owners and frontage affected are as described in Exhibit "C" attached hereto; and, WHEREAS, the City Council deems it in the best interest to assess the adjacent property owners for these improvements, in accordance with the procedures of Chapter 552 Local Government Code, V.T.C.A.; and, WHEREAS, notice of the public hearing shall be published at least three (3) times in the official newspaper of the City of Port Arthur; and, WHEREAS, written notice of the hearing shall be given to the adjacent property owners; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. P. R. No. 16676 Page 2 of 3 Section 2. That the public hearing on the proposed assessment is set for January 24, 2012 at 6:00 p.m. in the Council Chambers, 5` Floor, City Hall. Section 3. That pursuant to Section 552.066 of the Local Government Code, the City may assess the cost of an improvement against adjacent landowners as to the percent of the cost of constructing a water line extension on 63 Street from Pat Avenue to east of Diamond Avenue, as described in Exhibits `B" and "C" attached hereto. Section 4. That the assessments are not estimated to exceed the cost of $56,100 (10% paid by the City and 90% paid by the tax payer), as delineated in Exhibit `B ", which is the estimate for the entire project. Section 5. That in accordance with Section 552.066(c) of the Local Government Code, the governing body shall apportion and assess those costs it considers just and equitable, taking into account the special benefits in enhanced value to be received by those owners, and shall adjust the apportionment so as to produce a substantial equality of benefits received and burdens imposed, as delineated in Chapter 552 Local Government Code. Section 6. That the City Secretary shall publish notice of the public hearing in the official newspaper of the City three (3) times, and provide written notice to the adjacent property owners, as required by Section 552.069 Local Government Code. Section 7. That a copy of the caption of this Resolution shall be spread upon the Minutes of the Meeting of the City Council.
