This proposed ordinance appropriates $260,235 from the General Fund Balance to the Capital Improvements Fund to fund the portion of the developer agreement with D.H.S. Camellia Estates, LLP that is not related to water utility improvements. The agreement, approved December 6, 2005 provides for participation by the City of 30% of the estimated costs ($1,376,900), at $413,070. The agreement also will pay $100,000 to relocate and oversize a force main and lift station, increasing the City's cost of this project to $513,070. The City can fund the utility portion of the project, $152,835 of the primary agreement, plus $100,000 for the relocation and oversizing, through funds available in the Utility Improvements Bond Fund. There is no funding available for the remaining portion (drainage, streets). This budget amendment will allocate funds from the General Fund balance to fund this portion, $260,235. P. O. AN APPROPRIATION ORDINANCE AMENDING THE BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2005 AND ENDING SEPTEMBER 30, 2006 AS TO FUND THE DEVELOPER PARTICIPATION CONTRACT WITH D.H.S. CAMELLIA ESTATES, LLP, ADOPTED BY CITY ORDINANCE 05-90 ON DECEMBER 6, 2005 WHEREAS, in accordance with Article XII, Section 9, of the City Charter, the City Council may make emergency appropriations from time to time; and WHEREAS, the City Council may make budget amendments for emergencies under Section 102.009 and for Municipal purposes under Section 102.010 Local Government Code. WHEREAS, on October 11, 2005, the City Council approved and adopted Ordinance 05-72 which appropriated the 2005-2006 budget; and WHEREAS, the City Council adopted Ordinance 05-90 on December 6, 2005, authorizing a developer participation agreement with D.H.S. Camellia Estates, LLP; and WHEREAS, the City Council desires to provide incentives to this incentive agreement in an amount not to exceed $513,070; and WHEREAS, these amendments are necessary for municipal purposes to meet unusual and unforeseen conditions as delineated in Section 102.009 (c) Local Government Code. BE IT ORDAINED BY TItE CITY COUNCIL OF THE CITY OF PORT ARTHUR Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the General Fund Budget be increased by $260,235 to fund streets and drainage improvements provided by the developer participation agreement adopted by Ordinance 05-90. Section 3. That Section 2 of the Budget Ordinance 05-72 be amended to read: That there be and is hereby appropriated the sum of Thirty Eight Million Two Hundred Seventy Thousand Forty One Dollars ($38,270,041) to the General Fund for the payment of the Operating Expenses, and necessary Capital Outlay for the City Government for the following Departments and uses: Department/Use Administration $ 1,173,008 City Secretary 607,478 City Attorney 499,594 Finance 1,445,950 Human Resources 590,330 Planning and Grants Management 842,475 Community Services 1,429,871 Civic Center 352,462 Parks and Recreation 1,597,378 Library 1,034,749 Police 11,806,333 Fire 8,619,896 Health 804,276 Public Works 6,323,006 Transfer to General Liability Fund 883,000 Transfer to Capital Improvement Fund 260,235 TOTAL $ 38,270,041 Section 4. That a copy of the caption of this Ordinance be spread upon the minutes of the City Council. Section 5. That this Ordinance shall be effective immediately.
