Comeaux, P.E., Acting City Manager FROM: Lisa Colten, Safety & Risk Management Coordinator DATE: April 9, 2012 SUBJECT: A Resolution Approving a Property Damage Settlement in the Amount of $11,464.82 for Damages to City of Port Arthur Police Vehicle #1815 COMMENTS RECOMMENDATION: I recommend approval of Proposed Resolution No. 16993 authorizing the property damage settlement against Christopher Madden (Thresa Wingate, vehicle owner) and Southern Farm Bureau Casualty Insurance Company (Southern Farm Bureau) for damage sustained to Police Vehicle #1815 (2010 Dodge Charger). The amount of the proposed settlement is $11,464.82. The proposed settlement amount represents the final cost of property damages; therefore, this is considered a fair and reasonable settlement. BACKGROUND: On December 20, 2011, City Police Vehicle #1815 struck a vehicle operated by Mr. Madden who had failed to yield the right -of -way. A property damage claim was filed with Southern Farm Bureau, liability insurance carrier for Mr. Madden and Ms. Wingate, for the cost of damage expenses to the Police vehicle. Southern Farm Bureau has offered the City $11,464.82 to settle this property damage claim on behalf of Mr. Madden and Ms. Wingate. BUDGETARY /FISCAL EFFECT: The funds received will be deposited in the account recommended by the Finance Director. STAFFING /EMPLOYEE EFFECT: No effect on staffing levels: SUMMARY: I recommend approval of Proposed Resolution No. 16993 authorizing the property damage settlement against Christopher Madden (Thresa Wingate, vehicle owner) and Southern Farm Bureau Casualty Insurance Company (Southern Farm Bureau) for damage sustained to Police Vehicle #1815 (2010 Dodge Charger). A RESOLUTION AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EXECUTE THE SETTLEMENT OF AN AUTOMOBILE PHYSICAL DAMAGE CLAIM IN THE AMOUNT OF $11,464.82 MADE AGAINST CHRISTOPHER MADDEN, THRESA WINGATE, AND SOUTHERN FARM BUREAU CASUALTY INSURANCE COMPANY AS A RESULT OF THE PROPERTY DAMAGE TO CITY POLICE VEHICLE #1815 WHEREAS, on December 20, 2011, City of Port Arthur Police Vehicle #1815 (2010 Dodge Charger) was damaged when it struck a vehicle which had failed to yield the right -of -way; and, WHEREAS, as a result of the damage, a claim was filed with Christopher Madden, Thresa Wingate, and Southern Farm Bureau Casualty Insurance Company (Southern Farm Bureau); and, WHEREAS, Southern Farm Bureau has offered to settle the claim for $11,464.82 (final cost of repairs), which is considered a fair and reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to do all things necessary to execute settlement in the amount of $11,464.82 for the claim against Southern Farm Bureau. Section 3. That, a copy of this Resolution be spread upon the minutes of the City Council.
