HomeMy WebLinkAboutPR 17034: SET FUNDING FOR PRETREATMENT PROGRAM MEMORANDUM CITY OF PORT ARTHUR UTILITY OPERATIONS DEPARTMENT TO: John Comeaux, P.E., Acting City Manager FROM: Kelly Eldridge, Director of Utility Operations 1%4 f DATE: May 1, 2012 SUBJECT: Proposed Resolution No. 17034 COMMENTS RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 17034, which identifies the appropriate funding in the Fiscal Year 2011 -2012 Utility Operations budget. The Utility Operations Department is required to implement the City's Pretreatment Program (Ordinance No. 11 -16) per the Texas Commission on Environmental Quality (TCEQ) and the City's TPDES permits. BACKGROUND In keeping with our Main, Port Acres, and Sabine Pass Wastewater Treatment Plants TPDES discharge permit requirements, last year the City approved a major modification to our existing Pretreatment Program (Ordinance No. 11 -16). The TCEQ requires that we document that we have appropriate funding to operate this program annually. Under the Pretreatment Program, we perform testing, inspections, and reporting of the compliance history of our permitted Industrial Users. BUDGET/FISCAL EFFECT: Currently, the Department has funds available in the FY 11 -12 budget for regular wages and professional services to implement this program. This PR does not require additional funding for this program. STAFFING/EMPLOYEE EFFECT: Existing staff monitor the Industrial Users of the City's sanitary sewer system throughout the year, by performance of facility inspections, on -site sampling, review of IU's activities for compliance with the City Pretreatment Program and TCEQ guidelines, and preparation of an annual report. SUMMARY: I recommend approval of Proposed Resolution No. 17034 in order to meet TCEQ requirements verify the availability of appropriate funding for manpower and annual testing to implement the City's Pretreatment Program. A RESOLUTION STATING THE INTENT OF THE CITY OF PORT ARTHUR, TO SET FUNDING OF THE PRETREATMENT PROGRAM AT A LEVEL SUFFICIENT TO MEET APPLICABLE FEDERAL AND STATE REGULATIONS AS SET FORTH BY TPDES PERMIT NO. WQ0010364 -001, WQ0010364 -002, and WQ0010364 -010. WHEREAS, the City of Port Arthur has the duty and desire to protect the Public Health, Safety and Welfare of its citizens by the provision of an Industrial Pretreatment Program; and, WHEREAS, the City of Port Arthur has determined the need to provide adequate treatment to prevent pollutants passing through our sanitary sewer collection and treatment systems from passing into the receiving waters, or otherwise be incompatible with said systems; and, WHEREAS, the Texas Commission on Environmental Quality (TCEQ) requires a resolution of funding to operate our Industrial Pretreatment Program annually from the governing authority of the City of Port Arthur; and, WHEREAS, funding is appropriated in the FY 2011 -12 Utility Operations Administration Budget for manpower and testing to operate the program; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the City Council does hereby authorize funding for the Pretreatment Program from the appropriate Utility Operations Budget to meet applicable Federal and State environmental regulations; and, THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
