RECOMMENDATION:
It is recommended the City Council adopt Proposed Resolution #17044,
authorizing the certification of Tender Loving Care Center for Children d /b /a
Legacy Community Development Corporation, 3505 Procter Street, Suite 5, Port
Arthur, Texas as a Community Housing Development Organization (CHDO), to
assist with the mission of the City of Port Arthur in providing safe, sanitary
decent and affordable housing for low and moderate income persons /families
of the community.
BACKGROUND:
Among the purposes of the Cranston - Gonzalez National Affordable Housing Act
of 1990 (NAHA), as amended, the City a participating jurisdiction is required to
(1) promote partnerships with non - profit organizations, and (2) expand non -
profit organizations' capacity to develop and manage decent and affordable
housing.
The Housing Division has HOME Funds available for CHDOs.
To assist in achieving these purposes, participating jurisdictions are encouraged
to identify Community Housing Development Corporations that are capable, or
can reasonably be expected to become capable, of carrying out elements of its
housing programs. It is essential that participating jurisdictions build and
strengthen partnerships with Community Housing Development Corporations.

It is recommended that the City of Port Arthur certify that this organization met
the minimum requirements of 24 CFR and designate Tender Loving Care Center
for Children d /b /a Legacy Community Development Corporation as a
Community Housing Development Organization (CHDO) in accordance with a
portion of the process as delineated in 24 CFR 92.
Prior to allocating HOME and /or any other funds to the organizations, additional
criteria must be met according to 24 CFR 92, which are, organization and
structure according to the standards provided in the HOME regulations, and
must develop, own or sponsor the HOME- assisted housing (24 CFR 92.300).
This organization, according to their Articles of Incorporation and Bylaws, have
obligated themselves to meet the requirements of the HOME Program and all
other Federal Regulations to assist in carrying out the mission of the City of
Port Arthur to eliminate blight, provide decent, safe, sanitary and affordable
housing for low and moderate - income persons /families of the community.
BUDGETARY /FISCAL EFFECT:
None.
STAFFING /EMPLOYEE EFFECT:
Housing staff will be responsible for providing technical assistance, guidance
and other resources to the CHDO's in efforts to build lasting partnerships.
SUMMARY:
It is recommended the City Council adopt Proposed Resolution #17044,

RESOLUTION NUMBER
A RESOLUTION AUTHORIZING THE CERTIFICATION OF
TENDER LOVING CARE CENTER FOR CHILDREN D /B /A
LEGACY COMMUNITY DEVELOPMENT CORPORATION AS A
COMMUNITY HOUSING DEVELOPMENT ORGANIZATION
(CHDO) IN ACCORDANCE WITH THE REQUIREMENTS OF
THE FEDERAL HOME PROGRAM.
WHEREAS, the City Council, by its adoption of Resolution
Number 12 -160, (authorizing submission of a 2012 Consolidated Plan) the City
has obligated itself to identify and build partnerships with CHDO's and non-
profit organizations; and,
WHEREAS, several non - profit organizations have submitted
application to the Housing & Neighborhood Revitalization Department
requesting Community Housing Development Organization designation; and,
WHEREAS, the organizations have been chartered Texas non - profit
corporations; and,
WHEREAS, under the requirements of 24 CFR 92.300, the
organizations meet a portion of the requirements of the Federal HOME Program
regulations for designating /certifying non - profit organizations as CHDO's; and,
WHEREAS, activities undertaken by the organizations must principally
benefit low and moderate income persons /families as has been determined by
the parties and is established under the guidelines of the Housing and
Community Development Act of 1974, as amended.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PORT ARTHUR:

Section 1. That the City of Port Arthur hereby certifies Tender Loving
Care Center for Children d /b /a Legacy Community Development Corporation, as
a Community Housing Development Organization (CHDO) in accordance with a
portion of the process as delineated in 24 CFR 92.
Section 2. That the certification is valid for one year as delineated in
the certificate attached hereto as Exhibit 'A':
Section 3. That the copy of the caption of this Resolution be spread
upon the minutes of the City Council.
