RESOLUTION NO.
A RESOLUTION CONCERNING APPROVAL
FOR THE CONSTRUCTION OF A TAX CREDIT
APPLICATION BY ONE SOUTHWOOD CROSSING,
LP WITHIN ONE LINEAR MILE OF
A PREVIOUSLY AWARDED DEVELOPMENT
SOUTHWOOD CROSSING, LP
WHEREAS, the governing body of the City of Port Arthur has
been apprised of a prospective application for iow income housing
tax credits (the "Application") to be filed by One Southwood
Crossing LP (the "Applicant"), with the Texas Department of Housing
and Community Affairs ("TDHCA"); and
WHEREAS, the proposed Application is seeking an allocation of
iow income housing tax credits for the construction of a multi-
family affordable housing complex to be known as Southwood Crossing
Apartments Phase II (the "Development") within the City of Port
Arthur; and
WHEREAS, the Development will be located within one linear
mile of Southwood Crossing Apartments, an affordable housing
complex which has received an award of tax credits within the last
three year period; and
WHERF_~kS, TDHCA requires the express approval of the governing
body of the City of Port Arthur in order for the Applicant to be
awarded an allocation of iow-income housing tax credits by TDHCA.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY

OF mORT A~THUR, TEXAS:
Section 1. That the facts and opinions in the preamble are
true and correct.
Section 2. The City of Port Arthur hereby authorizes an
allocation of iow income housing tax credits for the Development.
Section 3. The City of Port Arthur acknowledges that this
resolution shall constitute a written statement of support and
approval for the construction of the Development as required by
Section 50.5(8) of the 2006 Qualified Allocation Plan and Rules
adopted by TDHCA, as set forth in Title 10, Part 1 of the Texas
Administrative Code.
Section 4. That as a condition hereof, said apartment
complex shall be taxable and the Applicant shall sign this
Resolution agreeing herewith.
Section 5. That a copy of the caption of this Resolution
be spread upon the Minutes of the City Council.
