RESOLUTION NO.
A RESOLUTION APPROVING THE CONTINUED USE OF
SECTION 4A SALES AND USE TAX WITHIN THE CITY
OF PORT ARTHUR FOR DEMOLITION OF DILAPIDATED
STRUCTURES AND INFRASTRUCTURE LIMITED TO
STREETS AND ROADS, RAIL SPURS, WATER AND SEWER
UTILITIES, ELECTRIC AND GAS UTILITIES,
DRAINAGE, SITE IMPROVEMENTS, AND RELATED
IMPROVEMENTS NECESSARY TO PROMOTE OR DEVELOP
NEW OR EXPANDED BUSINESS ENTERPRISES WITHIN A
PROJECT AREA FROM 7 STREET TO THE
INTRACOASTAL CANAL AND FROM MARTIN LUTHER
KING, JR. DRIVE TO LAKE CHARLES AVENUE
WHEREAS, at the May 9, 2009 Election, the voters approved a
Proposition, as described in Exhibit "A" attached hereto, which
stated that for the next three (3) years, the existing Section 4A
sales and use tax within the City of Port Arthur will be utilized
to promote or develop new or expanded business that create or
retain primary jobs, including a project to provide demolition of
dilapidated structures and infrastructure improvements in the area
described (Downtown) and limited the amount of annual funding
available to $750,000; and
WHEREAS, said the Proposition also stated that said period of
time can be extended an additional three years by the City Council
by a 2/3 vote of the City Council after receiving public comment of
the proposed cost and impact of the projects; and
WHEREAS, the City Council held a public hearing on June 12,
2012,as to the continued use for an additional three (3) years of

Section 4A Sales and Use Tax within the City of Port Arthur being
utilized to promote or develop new or expanded business that create
or retain primary jobs, including a project to provide demolition
of dilapidated structures and infrastructure improvements in the
area described (Downtown,) which is a category of projects under
Section 4B of Article 5190.6 Vernon's Texas Code Annotated (Type B
of Section 505.155 Local Government Code), with the condition that
total annual spending on all Section 4B Projects by the City of
Port Arthur Section 4A Economic Development Corporation will not
exceed $750,000 through September 30, 2015.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble are
true and correct.
Section 2. That the City Council, by a 2/3 vote, has
approved the extension of three (3) years (until September 30,
2015) for the use of Section 4A funds to promote or develop new or
expanded business that create or retain primary jobs, including a
project to provide demolition of dilapidated structures and
infrastructure improvements in the area described (Downtown,) which
is a category of projects under Section 4B of Article 5190.6
Vernon's Texas Code Annotated (Type B of Section 505.155 Local
Government Code), with the condition that total annual spending on
all Section 4B Projects by the City of Port Arthur Section 4A
Economic Development Corporation will not exceed $750,000.
Section 3. That a copy of the caption of this Resolution

be spread upon the Minutes of the City Council.
