Blackketter, P.E., tor of Public Works SUBJECT P.R. #17123 — CO -03 — LDF for Port Arthur Fire Station #4 at Sabine Pass DATE 07 June 2012 RECOMMENDATION: I recommend that the City Council approve Proposed Resolution No. 17123, authorizing Change Order 03 to the contract with LDF Construction, Inc. for the Port Arthur Fire Station #4 at Sabine Pass, decreasing the contract by $150.38 to a new total amount of $1,722,969.87. BACKGROUND: The City Council previously executed a contract with LDF for the Port Arthur Fire Station #4 at Sabine Pass in the initial amount of $1,687,177, which was increased by Change Orders 01 and 02 to the amount of $1,723,120.25. Change Order 03 decreasesthe contract by $150.38 to a new total amount of $1,722,969.87. This change order is to accommodate the addition of a guardrail and replacing the specified vent hood in the kitchen. The project architect, Brown Reynolds Watford Architects, Inc., has reviewed the request, and recommends approval. BUDGETARY /FISCAL EFFECT: Funding will be provided for in Project IKEFS4, 121- 2300 - 901.82 -00. EMPLOYEE /STAFF EFFECT: None. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER 03 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND LDF CONSTRUCTION, INC. FOR PORT ARTHUR FIRE STATION #4 AT SABINE PASS, DECREASING THE CONTRACT BY $150.38 TO A NEW TOTAL AMOUNT OF $1,722,969.87. PROJECT IKEFS4, 121- 2300 - 901.82 -00. WHEREAS, in Resolution 11 -520 the City entered into a contract in the amount of $1,687,177 with LDF Construction, Inc. for Port Arthur Fire Station #4 at Sabine Pass which was subsequently increased to a total of $1,723,120.25 by Change Orders 01 and 02; and, WHEREAS, due to a change in the specifications, LDF has requested Change Order 03 decreasing the contract by $150.38 to a new total amount of $1,722,969.87, attached hereto as Exhibit "A "; and, WHEREAS, approval of Change Order 03 is herein deemed an appropriate action; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, Change Order 03 is herein approved and the City Manager is authorized to execute said Change Order; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. This Change Order is specific and final as to price and extension of time, with no reservations or other provisions allowing for future additional money or time as a result of the particular changes identified and fully compensated in this Change Order. Signature of the Contractor indicates his agreement herewith, including adjustments to the contract term and contract time.
