NO 17110 REQUESTING THE CITY COUNCIL TO APPROVE ADDITIONAL PROMOTIONAL FUNDS FOR THE RENOVATION OF THE DOWNTOWN PAVILION FOR THE CITY OF PORT ARTHUR SECTION 4A ECONOMIC DEVELOPMENT CORPORATION P.R. No. 17110 5/30/12 CS RESOLUTION NO. A RESOLUTION APPROVING ADDITIONAL PROMOTIONAL FUNDS IN THE AMOUNT OF $29,366 FOR THE RENOVATION OF THE DOWNTOWN PAVILION WHEREAS, on May 9, 2009, a ballot proposition was presented to and approved by the qualified voters in the City of Port Arthur, Texas (the "City ") for the City of Port Arthur Section 4A Economic Development Corporation (the "PAEDC ") to utilize Section 4A sales and use tax funds for "the cost of demolition of dilapidated structures and infrastructure limited to streets and roads, rail spurs, water and sewer utilities, electric and gas utilities, drainage, site improvements and related improvements necessary to promote or develop new or expanded business enterprises within a project area from 7 Street to the Intracoastal Canal and from Martin Luther King, Jr. Drive to Lake Charles Avenue within the City "; said authority limited to the PAEDC's expenditure of not more than $750,000 per year for said projects (the "Ballot Proposition "); and WHEREAS, the City has submitted an Application for the architectural /engineering design phase services, contracted with URS, related to the renovations of the Downtown Pavilion in accordance with the Application and made a part hereof for all purposes; and WHEREAS, on April 5, 2010, the Board of Directors of the PAEDC considered and approved funding the Application of the City in the amount of $150,000.00 for the architectural /engineering design phase related to the renovations of the Downtown Pavilion as outlined in the Application; and WHEREAS, on September 13, 2010, the Board of Directors of the PAEDC considered and approved funding an additional $89,875 for the architectural /engineering design phase related to the renovations of the Downtown Pavilion as outlined in the Application; and WHEREAS, on September 21, 2010, the City Council approved funding an additional $89,875 for the architectural /engineering design phase related to the renovations of the Downtown Pavilion as outlined in the Application; and WHEREAS, on June 20, 2011, the Board of Directors of the PAEDC considered and approved funding an additional $156,539.59 for the renovations of the Downtown Pavilion; and WHEREAS, on May 15, 2011, the City Council appropriated additional funds in the amount of $150,000 for the renovations of the Downtown Pavilion per Ordinance 12 -31; and WHEREAS, on June 4, 2012, the Board of Directors of the PAEDC considered and approved allocating an additional $29,366 to complete the renovations of the Downtown Pavilion; and WHEREAS, funds are available during fiscal year 2011 -2012 from PAEDC's Promotional Development Account (120- 1429 - 582 - 59.06) to fund the renovations of the Downtown Pavilion. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the PAEDC is hereby authorized to allocate additional funds of $29,366 from PAEDC's Promotional Development Account (120 - 1429 - 582 - 59.06) for fiscal year 2011- 2012 to fund the renovations to the Downtown Pavilion. #933659 Page 2 Section 3. That a copy of this Resolution shall be spread upon the Minutes of the City Council.
