HomeMy WebLinkAboutPO 5587: CHARTER CHANGESMEMORANDUM
To: Mayor, City Council, and City Manager
From: Mark T. Sokolow, City Attorney /~ ~ ~
Date: February 10, 2006
Subject: P. O. No. 5587 - February 14, 2006 Council Meeting
Attached is P. O. No. 5587. The propositions as to proposed
charter changes will need to be inserted by individual motion at
the Council Meeting. For example, a council member needs to make
a Motion to adopt P.O. 5587. Once that Motion has been seconded,
another motion can be made to amend P.O. 5587 to add a
proposition thereto as described in this memo or such other
proposed change to the City Charter as the Council so desires.
Once that Motion to Amend has been approved as to that
proposition, additional motions to amend can be made as to add
additional propositions to P.O. 5587.
Herein are the suggested propositions that the Council can
add if the City Council so desires as it pertains to charter
changes. Nevertheless, not all of them can be added to this
election as some of them conflict:
z .po5587 .memo 1
The Council can place one or the other of the following two
propositions on the Ballot. Both of these propositions cannot be
placed on the ballot, since they conflict.
PROPOSITION
Shall the last line of Section I of Article II of the
City Charter be deleted as to remove the prohibition that
neither the Mayor nor any Councilmember shall serve more
than three {3) consecutive terms in the same office.
PROPOSITION
Shall the last line of Section 1 of Article II of the City
Charter be amended as follows:
~Neither the Mayor nor any Councilmember from Districts
I through 6 shall serve more than three consecutive
three year terms in the same Council Position. The
Councilmembers from Districts 7 and 8 shall not serve
more than five consecutive terms in the same Council
Position."
z .po5587 .memo 2
The Council can place one (1) or the other of the following
two (2) propositions on the Ballot. Both of these propositions
cannot be placed on the ballot, since they conflict.
PROPOSITION
Shall Section lA of Article II of the City Charter be
amended as follows:
"Section iA. Council Positions 7 and 8
Until May 2008, Council Positions 7 and 8 shall
have two (2) year terms. The elections of Council
Positions 7 and 8 shall be in the year 2008 and
thereafter by a majority vote, and they shall have
three (3) year terms. This provision supercedes
any conflicting portion of the City Charter in
relation to the election of Council Positions 7 and
8."
PROPOSITION
Shall Section iA of Article II of the City Charter be
amended as follows:
"Section iA Council Position 7 and 8. Council Positions
at Large (2).
Council Positions 7 and 8 shall be elected at large for
two (2) year terms. The candidates shall have resided
twelve (12) months in the State and twelve months in the
City immediately preceding the election date. The terms
for each position shall be two (2) years. These
positions shall be voted on as one race by all voters of
the City. Each voter is entitled to cast two votes. A
voter may not cast more than one vote per candidate. If
a voter casts more than two (2) votes, none of the
voter's votes may be counted in that election. If a
voter casts fewer votes than entitled, all of the voter's
votes are counted in that election. The two candidates
receiving the most votes shall be elected to these
positions. This provision supersedes any conflicting
portion of the City~ Charter in relation to the election
of Council Positions 7 and 8."
z .po5587 .memo 3
pROPOSITION=
Shall Section lB be added to Article II of the City Charter:
~Section lB Residency for Council Positions 7 and 8
The Councilmembers for Positions 7 and 8 may
reside in any district. This provision
supersedes any conflicting portion of the City
Charter in relation to the election of Council
Positions 7 and 8."
PROPOSITION:
Shall Section 7 of Article XIV of the City Charter be
amended as follows:
~Section 7. Sale or Lease of Property.
~No right, title or interest of the City and
to any property shall be sold or leased unless
authorized by the City Council by a Resolution
if it is a lease and by an Ordinance if it is
a sale."
PROPOSITION:
Shall the fourth sentence of Section 1 of Article XIV
of the City Charter be amended as follows:
~All contracts for expenditures shall be
authorized in accordance with the minimum
standards as delineated under state law."
PROPOSITION:
Shall the first two sentences of Section 3 of
Article II of the City Charter be amended as it
pertains to salaries and car allowances for the
Mayor and City Council.
"The Mayor and Councilmembers shall receive a
salary and car allowance as delineated in an
Ordinance set by the City Council at such time
as they approve the fiscal year budget for the
City, with due opportunity for public
comment."
