Secs. 10- 53- 10 -80. - Reserved. Sec. 10 -41. - Keeping of livestock. (a) Keeping, possessing or maintaining livestock shall be unlawful unless in compliance with the zoning ordinance and this Code. (b) It shall be unlawful for any person to keep, possess or maintain livestock on any tract of land less than two acres in area. No more than three head of livestock shall be kept, possessed or maintained on a two -acre tract of land. An additional one -half acre shall be required for each additional animal. (c) In addition, it shall be unlawful for any person to keep, possess or maintain any livestock within 150 feet of any residence or building used for human habitation (other than that of the keeper or owner of the animal), any business, church, school or hospital. If the animal is kept in or confined by any building or structure such as a stable, barn. shed or pen, the distance of 150 feet shall be measured in a straight line from the nearest point of the building or structure to the nearest point of the building used for human habitation, business, church, school or hospital. If the animal is staked or fenced, the distance of 150 feet shall be measured in a straight line from the animal or fence to the nearest point of the building used for human habitation, business, church, school or hospital. (d) Notwithstanding subsection (c) of this section, the distance shall be 75 feet instead of 150 feet if the tract of land on which the animal is kept is located in one of the following areas as defined and shown in Exhibit A, which is on file in the city secretary's office: (1) West of West Port Arthur Road but excluding Palomar and Lakeside Additions; (2) Montrose Addition and the area north of Highway 365 and west of Highway 69; (3) Sabine Pass area; and (4) El Vista area but excluding Vista Village and Sunset Garden. Port Arthur, Texas, Code of Ordinances Page 1 of 5 PART 11 - CODE OF ORDINANCES Chapter 10 - ANIMALS ARTICLE 11. - LIVESTOCK/DOMESTIC FOWL (e) For properties not complying with the above distance provision at the adoption of this section, the property owners or occupants of these properties shall have six months from the effective date of this section to comply by moving their fence, pen, barn, stable, or shed to the required minimum distance as described in this section. If the animal is staked, the property owner or occupant shall comply immediately upon the effective date of this section. (f) Subsections (b) and (c) of this section shall not apply to a tract of land located in an area described in subsection (d) of this section if: (1) The tract of land was used on or before September 1, 1994, to keep, possess or maintain livestock; (2) Since September 1, 1994, the use has never been abandoned or discontinued for one year or more; (3) Such use has not materially changed and the number of livestock has not increased and the distance has not decreased since September 1, 1994; and (4) The premises are kept in a sanitary and nuisance -free condition. (Code 1961, § 4 -2) Sec. 10 -42. - Unrestrained livestock and domestic fowl. The owner of any livestock or domestic fowl shall not permit the same upon public property, whether staked, tied or in the charge of any person, regardless of the means of restraint, except for an event specifically permitted by the public entity having authority over such public property. The owner of any livestock or domestic fowl shall not permit the same to trespass upon the lands of any person other than the owner of such livestock or domestic fowl. (Code 1961, § 4 -18) Sec. 10 -43. - Running at large. It shall be unlawful for the owner of any livestock or domestic fowl to permit the same to run at large within the city. (Code 1961, § 4 -19) Sec. 10 -44. - Animal control officers duties; impounding and caring for livestock and domestic fowl; notice to owner. It shall be the duty of the animal control officer to cause all livestock and domestic fowl of any kind in violation of section 10 -43 to be impounded in the animal shelter and to be properly fed, watered and cared for. When the animal control officer shall have impounded any livestock or domestic fowl under the provisions of this article, he shall, within 24 hours, notify the owner or keeper, if known or ascertainable, personally or in writing, of such impoundment, and to redeem such livestock or domestic fowl from such animal shelter by payment of the fees, fines, expenses and costs of impoundment and keeping the same, within a period not to exceed five days from the date of impoundment. Port Arthur, Texas, Code of Ordinances Page 2 of 5 PART II - CODE OF ORDINANCES Chapter 10 - ANIMALS ARTICLE II. - LIVESTOCK/DOMESTIC FOWL Sec. 10 -45. - Impounding fees. The fees and costs for retaining, impounding, feeding and keeping livestock and domestic fowl are fixed and established as follows: (1) For detaining and impounding: a. Each head of livestock $30.00 b. Each domestic fowl 25.00 (2) For feeding and keeping: a. Each head of livestock, per day 15.00 b. Each domestic fowl, per day 3.00 (Code 1961, § 4 -20) Sec. 10 -46. - Disposition of livestock and domestic fowl not redeemed in timely manner. If the owner has not secured the release of any livestock or domestic fowl impounded under the provisions of this article within five days after it has been impounded, then it shall be sold at public auction or humanely destroyed as provided in section 10 -201. (Code 1961, § 4 -22) Sec. 10 -47. - Keeping of hogs. (a) It shall be unlawful for any person to keep or maintain any hogs or pigs within the city except when they are kept on a tract of land that is not less than two acres (87,120 square feet). No more than three head of hogs or pigs more than four months old shall be kept, possessed or maintained on a two -acre tract of land. An additional one -half acre shall be required for each additional animal. Hogs or pigs cannot be kept in residentially zoned districts. (b) It shall be unlawful to keep, possess or maintain any hog or pig within 500 feet of any residence or building used for human habitation (other than that of the keeper or owner of the animal), any business, church, school or hospital. The distance shall be measured in a straight line from the nearest point of the pen, fence or hog or pig to the nearest point of the residence or building. Adequate shelter shall be provided. (Code 1961, § 4 -4) Sec. 10 -48. - Protection of birds; state law governs. Protection of birds is governed by V.T.C.A., Parks and Wildlife Code § 64.002. (Code 1961, § 4 -11) Sec. 10 -49. - Keeping of pigeons. It shall be unlawful for any person to keep or maintain any pigeon house, or place to keep pigeons or to keep or maintain pigeons for breeding or other purposes within the city, except when confined in a Port Arthur, Texas, Code of Ordinances Page 3 of 5 PART II - CODE OF ORDINANCES Chapter 10 - ANIMALS ARTICLE II. - LIVESTOCK/DOMESTIC FOWL house or coop. (Code 1961, § 4 -5) Sec. 10 -50. - Unlawful keeping of gamefowl and gamecocks. (a) This section shall not be construed to authorize the fighting of gamecocks, since the causing of one animal to fight with another is prohibited by V.T.C.A., Health and Safety Code § 821.021 et seq. (b) It shall be unlawful for any person to keep or harbor any gamecock or gamefowl within the corporate limits of the City of Port Arthur. (c) An individual who is found to keep, possess, or maintain a gamecock or gamefowl is subject to: (1) A warning for removal of the gamecocks or gamefowl in 72 hours, issued by animal control or a police chief designee. (2) After a warning has been issued and 72 hours have commenced and the gamecocks or gamefowl are still present in the city, the individual committing the offense is subject to a fine of up to $2,000.00 per gamecock and /or gamefowl and the animals will be seized and humanely euthanized. (Code 1961, § 4 -7; Ord. No. 10 -33, exh. A, 6 -29 -2010) Sec. 10 -51. - Chickens, ducks and fowl numbers limited; pools. (a) It shall be unlawful for any person to keep, possess or maintain chickens, ducks or fowl within the city, except when the chickens, ducks or fowl are fenced in, and coops, pens or cages are provided. (b) It shall be unlawful for any person to keep, possess or maintain any such fowl within 150 feet of any residence or building used for human habitation (other than that of the keeper or owner of such fowl), any business, church, school or hospital. (c) It shall be unlawful for any person living in a residential district to keep more than five chickens, ducks or fowl on any premises in a residential district unless that premises has at least 7,500 square feet of area. (d) It shall be unlawful for any person living in a residential district to keep more than ten chickens, ducks or fowl per premises unless that person has at least one acre (43,560 square feet) of land. Duck or waterfowl pools are prohibited within the city. (e) All droppings from coops, pens, cages, yards and other enclosures shall be removed regularly, and disposal of the excretions shall be handled in such manner as to keep the premises free of any public health nuisance. (Code 1961, § 4 -12) Sec. 10 -52. - Keeping of roosters. (a) A person may keep, possess or maintain two roosters (not considered to be gamecock) per each 20 acres of land where the individual is domiciled. However, it shall be unlawful for any person to keep, possess or maintain more than four total roosters (not considered to be a gamecock), regardless of the amount of acreage. (2) After a warning has been issued and 72 hours have commenced and the roosters are still present in the city, the individual committing the offense is subject to a fine of up to $250.00 and the roosters will be seized and /or humanely euthanized.
