INTEROFFICE MEMORANDUM To: THE CITY OF PORT ARTHUR - PLANNING AND ZONING COMMISSION FROM: RONALD BURTON, DIRECTOR OF PLANNING SUBJECT: Z12 -07 - PROPOSED AMENDMENT REQUESTED FOR - APPENDIX A (ZONING ORDINANCE), SECTION 8 -106, PORT ARTHUR CODE OF ORDINANCES, OFF - STREET PARKING AND LOADING REQUIREMENTS FOR THE CITY OF PORT ARTHUR, JEFFERSON COUNTY, TEXAS DATE: 7/23/2012 BACKGROUND: The Planning and Zoning Commission is being asked to consider a proposed revision to Section 8 -106 of the City of Port Arthur's Zoning Ordinance (Amendment A of the City's Code of Ordinances) regarding required location for off - street parking and loading spaces. In the past, the existing wording of this section has created confusion for the city's environmental inspectors who sought to enforce a supposed prohibition against parking vehicles on grass or soil areas in the front yards of residences in the city. This confusion traces back to a ruling made by a former city attorney who based his opinion on the wording of the section heading ( "Parking prohibited in front yards ") despite the fact that the purpose of the section in the Zoning Ordinance is to described the location and number of required of- street parking spaces pertaining to residential and commercial properties in the city. Section 8 -106 addresses how many off - street parking spaces are required and where they must be located. The purpose of the section is not to describe locations where parking is prohibited. Parking prohibition is addresses in Section 106 "Traffic," Article IV "Stopping, Standing, Parking" of the city's Code of Ordinances. On Aug. 7, the City Council will consider amending Section 106 -225 to specifically prohibit the parking of vehicles in front or side yards of residences unless an all- weather parking surface has been installed. Currently States... Section 8 -106. Parking prohibited in front yards. All required off-street parking shall be located behind the minimum required front yard. Proposed revision... Section 8 -106. Designated location for required off- street parking spaces. All required off-street parking spaces shall be located behind the minimum required front setback line (building line) as established for the applicable zoning district. Notice was published in the Port Arthur News on Sunday, July 22, 2012, more than ten (10) days prior to the P &Z public hearing scheduled for August 6, 2012. RECOMMENDATION: The Planning staff has no objections to the approval of this request. BUDGETARY /FISCAL EFFECT: None STAFFING /EMPLOYEE EFFECT: None SUMMARY: The request conforms to all zoning requirements, hence acceptance of this case is recommended. 2 PART II - CODE OF ORDINANCES APPENDIX A - ZONING SECTION 8. - OFF - STREET PARKING AND LOADING REGULATIONS SECTION 8. - OFF - STREET PARKING AND LOADING REGULATIONS 8 - 101.
