PR 17307: NELSON COLLABORATIVE CERTIFICATE OF SUBSTANTIAL COMPLETION

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ACCEPT THE ARCHITECT'S CERTIFICATE OF SUBSTANTIAL COMPLETION FROM THE NELSON COLLABORATIVE FOR THE CONSTRUCTION OF TWO (2) SOFTBALL FIELDS AT SSGT LUCIAN ADAMS PARK WHEREAS, the City of Port Arthur is the recipient of an Outdoor Grant from the Texas Parks and Wildlife Department; and, WHEREAS, said grant is to improve the quality of life for citizens and visitors by expanding the utility and capabilities of SSgt. Lucian Adams Park; and, WHEREAS, pursuant to Resolution No. 11 -506, the City Council authorized a contract with N &T Construction Co., Inc. for the Texas Parks and Wildlife Department funded construction of two (2) softball fields at SSgt Lucian Adams Park; and, WHEREAS, the softball fields are now substantially complete and have met all of the required building codes, zoning requirements, inspections, etc., as delineated in the Code of Ordinances of the City of Port Arthur; WHEREAS, the City of Port Arthur has been presented a Certificate of Substantial Completion attached hereto as Exhibit "A "; and, WHEREAS, staff recommends to City Council that the City Manager be authorized to accept said Certificate of Substantial Completion as delineated herein; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions of the preamble are true and correct. Section 2. That the City Manager is hereby authorized to execute the Certificate of Substantial Completion in a form approximate to that of Exhibit "A ". Section 3. That prior to taking full and final possession of the softball fields, all items indicated in the Punch List (incorporated in the Certificate of Substantial Completion) shall be completed by the Contractor, N &T Construction Co., Inc. P. R. #17307 09/25/12/ca Section 4. That an authorized representative of N &T Construction Co., Inc. shall sign a copy of the resolution agreeing to the terms thereof. Section 5. That prior to the release of project retainage monies, the Director of Parks and Recreation and the Assistant City Manager of Operations or the Director of Public Works must certify to the City Manager that the softball fields are complete and all items listed in the Punch List (incorporated in the Certificate of Substantial Completion) have been finished and the Director of Parks and Recreation must be in receipt of all warranties related to the softball fields. Section 6. That a copy of the caption of the Resolution be spread upon the Minutes of the City Council. Southwest side of construction area - Leaning trees (affected by construction activities) along the SW -NW boundary line tree buffer to be either removed or straightened up and stabilized. 2. All erosion control measures to be removed once the grass has established. 3. All exposed soil within the construction site to be seeded as provided on plan sheet C1.03 and specifications. Topsoil and seed application to be applied to all exposed surfaces including new ditches. 4. Weeds within construction limits to be eliminated. 5. All construction soils affected by construction traffic to be re- conditioned and grass seeded. Drainage 1. Clean up sediment within the drainage pipes. 2. All ditches affected by construction to be grassed. Parking 1. One of the HC parking spaces must be labeled with Van Accessible sign (see plan sheet C1.14) Dugouts 1. All dugouts - Bolts protruding inside dugouts along the fence crossbars could cause injury. Cut the protruding parts of the bolts at the fence behind the players' bench as well as at the opposite fence (facing players inside dugout). 2. All dugouts - Move all player benches forward to provide 7" gap between the top of benches backrest and the fence poles (8" to centerline of fence post). See side profile detail on plan sheet C1.08. Bleachers 1. The HC spaces at the ends of the bleachers should be marked with HC signs. These signs can either be painted on the concrete or on mounted signs. Sidewalk 2. All sidewalks to receive a strip of block sodding on both sides per plan and specifications. 3. Sidewalk side slope at the north of concession building (around the existing tree) is too steep. Side lope should be no steeper than 3 horizontal to 1 vertical. Softball Fields 1. In softball fields a pitcher's mound is not required (plan error). Level the pitcher's plate with the surrounding ground. 2. Install bases and pitcher's plate. See attachment for information. 3. Grades between infields and adjacent fences /dugouts dip. These low areas will cause water puddles an`�I soggy areas. Adjust grades for positive drainage. See plan contours — sheet C1.03. Ensure runoff from infield drains across sidewalk to the drainage swale behind bleachers per contours on plan sheet C1.03. Softball Field The softball diamond is closely related to the baseball diamond, which is one of the oldest and most complex pieces of geometric symmetry in all of sports. Of course, not every field is constructed exactly the same. Fields all across the world differ in terms of distances of baselines, outfield fences, and the pitching rubber. In the official rules of the International Softball Federation, the maximum outfield distance is stated to be 250 feet. Interestingly, this maximum is shared by both men and women. The variations in the distances are purely team - specific. While men's fields tend to be deeper, youth leagues and collegiate teams often have smaller outfields. Two sides measure 8.5 inches in length, and two sides measure 12 inches in length. The two 12 -inch sides form a point and face directly away from the pitcher's rubber. • Batter's boxes: Both the right -hand and left-hand boxes measure 3 feet in width and 7 feet in length; each box is 6 inches away from home plate, positioned so the midpoints correspond to the midpoint of home plate. • Catcher's box: The catcher's box measures 10 feet in length from the back of home plate, and 8.5 feet in width. Pitcher's Mound Area • Pitcher's rubber: The rubber is a white slab, measuring 24 inches by 6 inches. The pitching rubber should be level with the ground. • Pitcher's circle: The pitcher's circle should be a measurement of an 8 -feet radius around the pitcher's rubber. Bases and Baselines • First base: First base is a called a safety base or double base. It is the length of two bases, 15 inches wide and 30 inches long. The safety base is positioned across the first base line so that half of the base lies in fair territory and the other half lies in foul territory. The half that is in fair territory is painted white and the half that is in the foul territory is painted orange. • Second and third base: Second and third base are white, measure 15 square inches, and are 3 to 5 inches thick. Third base is positioned entirely in fair territory. Second base lines up squarely with first base and third base, so that the four bases form a perfect 60- foot square. • Distance from home plate to first base: 60 feet. • Distance from first base to second base: 60 feet. • Distance from second base to third base: 60 feet. • Distance from third base to home plate: 60 feet.
