AN ORDINANCE AMENDING CHAPTER 18 (BUILDINGS), ARTICLE III ELECTRICAL CODE, DIVISION 3 EXAMINATION AND REGISTRATION, SECTION 18 -135 CLASSIFICATIONS; SECTION 18 -136 FEES; BOND AMOUNTS; DIVISION 6 STANDARDS, SECTION 18 -221 ADOPTING THE 2011 NATIONAL ELECTRICAL CODE PUBLISHED BY THE INTERNATIONAL ELECTRICAL CODE SERIES TO THE CODE OF ORDINANCES OF THE CITY OF PORT ARTHUR; PROVIDING CERTAIN AMENDMENTS THEREWITH; PROVIDING A PENALTY FOR VIOLATION BY FINE NOT EXCEEDING TWO THOUSAND DOLLARS, AS PROVIDED IN SECTION 18 -43 OF THE CODE OR AS OTHERWISE IMPOSED BY STATE LAW; AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE IMMEDIATELY AFTER PUBLICATION. WHEREAS, the City Council desires to adopt the changes to the 2011 National Electrical Code attached hereto as Exhibit "A "; and WHEREAS, the City Council deems it in the best interest of the citizens of the City of Port Arthur to adopt the amendments to Section 18 -135, Section 18 -136 and Section 18 -221 adopting the 2011 National Electrical Code for the City of Port Arthur and may make variations thereto that do not substantially vary from the rules or laws of this State; and WHEREAS, the City Council of Port Arthur deems it in the best interest of the citizens of the City to adopt the proposed amendments to Chapter 18 Buildings; Section 18 -135; Section 18 -136 and Division 6 Section 18 -221 of the Electrical Code with the exceptions thereto. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That Chapter 18 Buildings Section 135, Section 136 and Division 6 Section 18 -221 of the Electrical Code of the Code of Ordinance is hereby amended to read as set forth in EXHIBIT "A ". Section 3. That all ordinances or parts of ordinances in conflict herewith are herein repealed, but only to the extent of said conflict. Section 4. That any person who violates any provisions of this Ordinance or who shall neglect to comply with the terms hereof shall be guilty of a misdemeanor and shall on conviction thereof be fined in any sum not less than One ($1.00) Dollar nor more than ($2,000) Dollars as provided in the Code of Ordinances, and each violation shall constitute a separate offense. Section 5. That the caption of this Ordinance and its penalty shall be published in the City's official newspaper at least one (1) time within ten (10) days after passage thereof. This Ordinance shall take effect immediately after the date of publication. Section 6. That a copy of the caption of this Ordinance is spread upon the minutes of the City Council. DIRECTOR OF CODE ENF`CEMENT EXHIBIT "A" Section 18 -135. Classifications. There shall be seven classes of electrical registration which shall be listed in this section from highest classification to lowest classification and are set forth as follows: 1. Qualified electrician; 2. Journeyman electrician; 3. Limited electrician (sign); 4. Residential electrical appliance installer; ** 5. Residential electrical appliance installation Contractor; ** 6. One and Two Family electrician 7. Maintenance electrician (lowest classification) * *New classification ** Section 18 -136. Fees; bond amounts. (a) The fees of registration and required surety bond or insurance of registration electricians of all classes shall be payable to the city, as set out in Table I in this section. (b) The registration fee shall be paid to the city and evidence of surety bond or insurance be provided before the issuance of certificate of registration and only after the person has been issued a certificate of competency from the International Code Congress PSI testing agency. (c) Annual renewal of certificate of registration cards for all classifications shall be required as set forth in this section and in compliance with the regulations of the electrical code. STANDARDS Section 18 -221. National Electrical Code 2011 Edition. The National Electrical Code 2011 Edition, hereinafter referred to as the "Electrical Code ", as published by the National Fire Protection Association, Quincy Massachusetts, Twelfth Edition of International Electrical Code Series, is herein adopted as the Electrical Code of the City of Port Arthur, save and except such portions as are herein deleted, modified, or amended, of which code not less than one copy has been and now is filed in the office of the City Secretary's of the City of Port Arthur and the same is hereby adopted and incorporated as fully as if set out in at length herein, and from the date on which this section shall take effect, the provisions thereof shall be controlling within the city limits of the city.
