SUBJECT P.R. #17356 — PCO #2 — Siemens for Energy Performance Contract

RECOMMENDATION:
I recommend that the City Council approve Proposed Resolution No. 17356, authorizing
Proposed Change Order #2 to the contract with Siemens Industry, Inc., Building Technologies
Division for the Port Arthur energy performance contract, revising the scope of services for the
Health Department and increasing the contract amount by $7,560 to a new total of $3,206,376.
BACKGROUND:
The City Council previously executed a performance contracting agreement with Siemens for
infrastructure improvements and efficiency upgrades in the amount of $3,198,816. The
contracted work includes, among other things, heating, ventilation, and air conditioning (HVAC)
work at the Health Department. Since the work has started, it has been found that the pump
for the hot water system (heating system) needs to be replaced. The cost of providing and
installing a new hot water pump is $7,560.
BUDGETARY /FISCAL EFFECT:
Funds are available in EPC 101, 302 - 1602 - 591.54 -00.
EMPLOYEE /STAFF EFFECT:
None.
SUMMARY
I recommend that the City Council approve Proposed Resolution No. 17356, authorizing

A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE PROPOSED CHANGE ORDER #2 TO THE
PERFORMANCE CONTRACTING AGREEMENT BETWEEN THE
CITY OF PORT ARTHUR AND SIEMENS INDUSTRY, INC.,
BUILDING TECHNOLOGIES DIVISION FOR INFRASTRUCTURE
IMPROVEMENTS AND EFFICIENCY UPGRADES, REVISING THE
SCOPE OF SERVICES AND INCREASING THE CONTRACT
AMOUNT BY $7,560 TO A NEW TOTAL OF $3,206,376. EPC
101, 302 -1602- 591.54 -00.
WHEREAS, in Resolution 12 -147 the City entered into a performance
contracting agreement in the amount of $3,198,816 with Siemens Industry, Inc.,
Building Technologies Division for infrastructure improvements and efficiency upgrades;
and,
WHEREAS, it has been discovered that the pump for the hot water system
(heating system) at the Health Department has failed and needs to be replaced; and,
WHEREAS, LDF has requested Proposed Change Order #2 for providing and
installing a new hot water pump for the amount of $7,560, attached hereto as Exhibit
"A"; and,
WHEREAS, authorization of Proposed Change Order #2 is herein deemed an
appropriate action; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City Manager is authorized to execute Proposed Change Order #2,
increasing the contract amount by $7,560 to a new total of $3,206,376, funding being

available in EPC 101, 302 -1602- 591.54 -00; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.
