Attached is P.R. No. 17359 calling for a public hearing to consider changing the zoning
restrictions in Planned Development - 26 (PD -26) for 96.21 acres of Land out of and part of
Lots 1, 2, 7 and 8, Block 4, Range "B" and Lots 1 and 2, Block 5, Range "B ", Port Arthur Land
Company Subdivision, City of Port Arthur, Jefferson County, Texas. The purpose of this
request is to include the temporary use of manufactured office buildings and establish
restrictions against permanent welding and machine shop activities.
A request is also being made to extend time for ten additional years for the land to be used
as a lay -down yard for turnaround and maintenance project.
The public hearing shall be held Tuesday, November 27, 2012 at 6:00 p.m.

RESOLUTION NO.
A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A
ZONING AMENDMENT FOR PLANNED DEVELOPMENT DISTRICT -
26 FORA 96.21 ACRE TRACT CONSISTING OF PART OF LOTS 1, 2, 7
AND 8, BLOCK 4, RANGE "B" AND LOTS 1 AND 2, BLOCK 5, RANGE
"B", PORT ARTHUR LAND COMPANY SUBDIVISION (PROPERTY
LOCATED NORTH OF HIGHWAY 87/73 AND ON THE WESTSIDE OF
HIGHWAY 366), CITY OF PORT ARTHUR, JEFFERSON COUNTY,
TEXAS
(Z12 -08 - TOTAL)
WHEREAS, the owner /applicant - TOTAL is requesting that the City of Port Arthur consider a zoning
amendment for PD -26 to include the temporary use of manufactured office buildings and establish restrictions
against permanent welding and machine shop activities; and,
WHEREAS, TOTAL has requested that an extension on time restraints be granted concerning the use of
land designated in PD -26 as a lay -down yard; and
WHEREAS, the Planning and Zoning Commission has recommended an extension of time be provided for
ten additional years for the land to be used as a lay -down yard for turnaround and maintenance, as delineated in
Exhibit "A "; thereby establishing a new expiration date of January 29, 2023; and,
WHEREAS, pursuant to Chapter 211 in the Texas Local Government Code, a public hearing must precede
any zoning change, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT the facts and opinions in the preamble are true and correct.
THAT the temporary use of manufactured office buildings be allowed in Planned Development District - 26
(PD -26).
THAT restrictions be established against allowing permanent welding and machine shop activities.
THAT the Planning and Zoning Commission has recommended an extension of time be provided for ten
additional years for the land to be used as a lay -down yard for turnaround and maintenance projects; thereby
establishing a new expiration date of January 29, 2023.
THAT a public hearing to consider whether to this applicant the zoning amendment requested for a 96.21
acre tract consisting of Lots 1, 2, 7 and 8, Block 4, Range "B" and Lots 1 and 2, Block 5, Range "B ", Port Arthur Land
Company Subdivision in Port Arthur, Jefferson County, Texas, as delineated in Exhibit "A" at which time members of
the public shall express their opinions about granting shall be held on November 27, 2012 at 6:00 p.m. in the City
Council Chambers, Fifth Floor, City Hall, 444 Fourth Street

THAT notice of the public hearing shall be published at least fifteen (15) days prior to the public hearing in the
official newspaper of the City.
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
